Compare And Contrast Unitary Vs Dual Federalism

Edwards and Wattenberg define Federalism as, “a way of organizing a nation so that two or more levels of government share formal authority over the same area and people. (Edwards and Wattenburg,70)” When the United States first started to form a central government their objective was to never allow for a dominating power to take over the country again. To do so they created a division of power and made it possible for states and more so the “people” the right to have more of an impact on government. Or so were their intended thoughts when creating the constitution and the branches. In doing so their focus constrained national government but left a loose string as to what the states and their constitutions could do.

Federalism Compare state sovereignty under the Articles of Confederation and under the Constitution. States were sovereign under the Articles of the Confederation although they shared no power under the constitution. It is the states that were supreme under the Articles of Confederation that led to the creation of a government that had a weaker national government. The executive arm of the government was not independent, and there were no federal courts since the state courts enacted all the laws (Brest, p.58). Also, neither did the Congress have the taxing power nor did it have the power to control interstate or foreign commerce.

James Madison argued that the power of both the state and federal government comes from its citizens and because of this there can be sovereignty on both a state and federal level. The Constitution also set out to solve this question by dividing the power between the state and federal government. The Constitution would be the “law of the land” but this would not impede state level powers or laws. Instead the federal government would oversee federal level concerns like taxing and creating an army. There were still many who felt that a large government would lead to a corrupt government with control in the hands of only a few.

I honestly believe that federalism is a stronger government. Federalism is the federal principle or system of government. Federalist believe in having a state with its own government. Federalist also believe in having a military which keeps the people under a Federalist state safe from outside harm. Also the Federalist believe having a national constitution meaning that there is a better balance of laws.

The Constitution uses division of powers in order to prevent tyranny from occurring. James Madison, a man who was very dedicated towards our Constitution, decided upon dividing the government into two different sections, state and central, this idea is known as federalism. Powers needed to run a country are granted to the central governments, a few of those powers are printing and coin money, declare war, and regulate trade, and powers given to the state governments are the ability to hold elections, establish schools, and set up local governments. ( Document A ). The idea of federalism is important because it has a major effect on the prevention tyranny.

Each part of the government had there own jobs to do, for example the central government has the power to regulate trade, conduct foreign relations, provide an army and navy, while the state government set up local governments, holds elections,

Under the British unitary system, U.S was a string of colonies. When the revolution implemented, U.S became a confederation under the articles of confederation and when that system verified as abortive, it was transformed into a federal system by the Constitution. This system is preferred for several reasons. The explanations may involve the size of the nation or the miscellany of the partisan divisions. As unitary system in the U.S and the diverse interests of different states made confederation impossible to run over.

To figure out how federal system of government differ from unitary and confederal systems of government first we need to know what they mean. Federal system is “a system of government in which the national government shares power with lower levels of government such as states (Ginsberg)”. Unitary system is “a centralized government system in which lower levels of government have little power independent of the national government (Ginsberg)”. Confederal system of government is “Sovereign states delegate power to a central government for specific purposes (Primohistory)” .So federal system is different because power is shared power is shared between all areas of government like local and state for example.

Federalism is when the power between the state and national government is shared. This power is also shared between states. This method of governing is to help the powers be distributed to run smoothly from national to state level. Confederation is states together to act on something that serves purpose to everyone. Most confederation is created because there is a major issue needing to be addressed.

The first two paragraphs I discussed the different types of government systems. The unitary system is primarily controlled by the central government . However, the central government does sometime giver permission for the locals to make decisions. Then, there is the federal system. The federal system break up the power between the nation and the states.
