BURBANK >> A Burbank man who allegedly brandished a weapon at police at his home, where his brother wound up dying after an officer used a Taser on him, pleaded not guilty Friday to three felonies.

Steve Leroy Binkley, 65, was charged Oct. 6 with two counts of resisting an executive officer and one count of exhibiting a firearm in the presence of an officer.

He is due back in court in Burbank on Nov. 28.

Police responded about 6:20 p.m. Oct. 5 to the home in the 500 block of North Mariposa Street in response to a criminal-threats report made by the former daughter-in-law of one of the men at the house.

Officers were speaking to Binkley’s 66-year-old brother, Thomas Wayne Binkley, outside the home when he became confrontational and “physically assaulted the officers,” police said. One of the officers deployed a Taser to subdue the man, who ultimately died at the scene.

Steve Binkley, meanwhile, allegedly brandished a weapon and ordered police to leave, prosecutors said. A standoff continued for about 40 minutes before Binkley surrendered.

Steve Binkley faces more than four years in jail if convicted, according to the District Attorney’s Office.
