  • DocketDescription: Order filed.; Notes: On June 2, 2022, the Tulare County Superior Court filed a "NOTICE OF INTENT TO FILE WRIT PETITION" signed by mother J.M. but purporting to be a notice of intent for both mother and father. It was due for filing on or before May 12, 2022. Pursuant to California Rules of Court, rule 8.450(e), the notice of intent was untimely filed. Therefore, it appears the above entitled case may be dismissed as to both mother and father unless petitioner J.M. can show exceptional good cause for the late filing of the notice of intent. Petitioner J.M. shall have 10 days from the date of this order to file a letter explaining why this court should not dismiss this matter as untimely filed. Petitioner's failure to respond to this order will be deemed agreement that the matter be dismissed. Additionally, the notice of intent was not signed by father E.S. California Rules of Court, rule 8.450(e) requires that the notice of intent be signed by the party or the party's attorney. Therefore, it does not appear that the notice of intent is operative as to father E.S. in addition to being untimely, and this court is considering dismissing the notice of intent as to father E.S. Petitioner E.S. shall have 10 days from the date of this order to file a letter explaining why this court should not dismiss this matter as inoperative as petitioner failed to sign the notice of intent and to further explain why this court should not dismiss the latter as untimely filed. Preparation of the record is stayed pending further order of this court.

On June 3, 2022 Angela Sanchez contacted Juliana Machuca (Mother) to confirm when she mailed out the Notice. No one answered, Angela left a voice message to call back our Appeals office. 4. On June 6, 2022, Angela Sanchez called again the mother Juliana Machuca. Julianna stated that she mailed out her notice a week after the hearing but, could provide a date. She also stated her packet got return due to not enough postage stamps. Juliana, mail again her package she couldn't confirmed when she mail the Notice of Intent back. 5. The Notice of Intent to file Writ Petition was received and stamp by the Appeals clerk on June 2, 2022.
