plus a boat believed to be smuggling migrants crashes off the coast of san diego. what we're learning about the victims. the third hour of "today in the bay" continues now. it's monday, thanks for joining us. i'm marcus washington. >> and i'm laura garcia. team coverage of the growing wildfire concerns across california. meteorologist kari hall is watching the forecast. sharon katsuda is tracking the fire danger happening in the east bay. we'll check in with her in about 30 minutes. we begin with kris sanchez, in the south bay and kris, the message from fire officials right now is very clear, be prepared. >> reporter: that's right. there was a whiff of smoke in the air here in the santa cruz mountains as firefighters battled a blaze here, and now we have the earliest red flag warning that we've had in almost 20 years. this is the fire that burned no that is started. fire.

it is an ominous sign of a wildfire season that may start months earlier because of fuel conditions looking like what we'd expect in the fall. with rainfall less than half of normal in most places around the bay area. the fires that raged here last year may still be smoldering. possibility of course that it was a smoldering hot spot that was left over from the czu lightning complex so many months ago. >> reporter: already cal fire responded to nearly double the number of fires that they did at this same time last year, about 1,300, compared to 800 last year, and that's why in morgan hill, residents tell us they're preparing their homes and properties much earlier than usual. statewide there is a half billion dollars set aside to hire more fight fears and improve forest management. most wildfires are started by

people and mos unintentional, so do pay close attention when you're out and about, don't do anything to spark a wildfire. in the santa cruz mountains, at lexington reservoir, kris sanchez, "today in the bay." >> thanks so much, kris. let's get to kari hall. >> kari, right now the urgent concern is really the red flag warning. >> yes, and i was just think being that in the santa cruz mountains and areas with very heavy vegetation and the recent fire, within the last year. it can just spark right up when it with these conditions. high winds, low humidity and very dry vegetation. but we do see the red flag warning that met that criteria of humidity below 15%, and winds over 25 to 35 miles per hour. we'll see that blowing through the delta valley and central valleys, red fire until 5:00 this evening. it will be windy again today and

watching out for dry conditions that will continue at times. we'll see some winds still remaining high into tomorrow. so you can get the anything that does break out with some live video and what we know, check it out there as well as our social media pages. we'll have another update coming up in a few minutes. on the pandemic front, the big big story, more reopenings are expected this week in the bay area and we are getting on the verge of getting more vaccine approved more millions of children. cierra johnson, this sounds like good news. >> reporter: good morning, marcus. good news indeed. both of those huge headlines are moving us a step forward in terms of the number of folks we can vaccinate as well as getting back to life pre-pandemic. we're going to start with what's going on here locally with san francisco potentially going to the yellow tier. now the state is expecting san

francisco to move into the less restrictive yellow tier as soon as friday. we're also keeping a close eye on marin county as they, too, so the big changes within the yellow tier, bars don't have to serve food and allowed to operate indoors at 25% capacity. other changes, gyms, wineries, the tasting rooms, those can be open indoors at 50% capacity, and as for the live events, that capacity is bumped up to 67%. some big news there. and as this news of loosened restrictions comes, as a former developments those under the age of 16, so as it stands right now, moderna is approved for those 18 and older, pfizer currently approved for 16 and older. but on sunday, the former commissioner for the food and drug administration was on a morning talk show and shared what developments are in the works for vaccinating those

younger than 16. take a listen. >> look, i'm hopeful that the fda will authorize the pfizer vaccine, the company i'm on the board of applied for permission to start giving its vaccine to 12 to 5year-olds. i'm hopeful the fda will authorize that in a short time period and i think once that gets authorized i think you'll pick up probably 5 million kids will get immediately vaccinated. there is about 17 million children between the age of 12 and 15. i think we'll pick up about 5 million immediately. >> reporter: that former fda commissioner discussed the possibility of making it so pediatricians would be able to administer the vaccines instead of vaccinating at the sites we've been seeing. as we continue to discuss the progress there's big news potentially happening friday and we'll keep an eye on the possibility of getting more shots in arms, specifically those in the younger age groups. we're live in san francisco, cierra johnson for "today in the bay." >> thank you.

india's vaccination drive is faltering as cases continue to surge there. nearly 10% of india's population received one dose but less than 2% are fully vaccinated. the u.s. is sending supplies worth more than $100 million to help, this is new video of that plane arriving overnight with some aid. a live look at sfo, beginning tomorrow, there will be no flights arriving from india. the biden administration is restricting travel from india to the u.s. the cdc advised the president to make that move. as soon as today oakland police expect to release more detailed on police arrested during intense may day protests saturday night. two officers were struck by flying debris and injured. officers made seven arrests. no reports of property damage. developing now, a boat captain is in custody after a vessel believed to be smuggling people into the united states crashed off the san diego shore. officials say the 40-foot cabin

cruiser was overcrowded with 30 people on board. as nbc bay area's miguel almaguer reports, 27 people were taken to area hospitals, three people died. >> reporter: laura and marcus, good morning. the investigation off the coast of san diego continues. we know at least four people are dead and dozens are hospitalized after a boat crashed into a reef investigators believe it was part of a smuggling ring. coming up on the "today" show, we'll have the very latest, including what's happening with the captain of the ship and what he's told investigators. guys, back to you. >> thanks, miguel. within the next six weeks or so, cities and counties across the bay area will nail down their budgets for the new fiscal year. some including oakland are cs to the police department. councilmembers will review the proposal today. the group looking at cutting the police budget in half over the next two years. the police officers union will

have to sign off on whatever gets approved. city college of san francisco now starting really staring at a huge budget cut, it could mean up to 65% of all collapses being eliminated. right now, san francisco supervisors are working on a new funding measure to provide some relief but there are concerns that it will fall far short and hundreds could still lose their jobs. the students and teachers will hold a virtual event to call for new action. now to making it in the bay, happening this week, plans for more affordable housing could move forward today in the south bay, to help house the homeless. tomorrow, the santa clara county board of supervisors expected to approve a $350 million bond for housing, the second phase of a $950 million affordable housing bond voters aproved four years ago. today county leaders will highlight the housing projects for which that money will be used. it's 6:08 monday

morning. weather and traffic getting the work week going. kari has a look at the morning forecast. >> get the outdoor activities done earl in concord it's going to heat up today, of course over the next few hours it's going to be the coolest, we go from 56 degrees in concord at 7:00, to 67 at 9:00 and look at this trend, it goes from green to red, and that means hot, we'll be in the mid 80s by early in the afternoon. we could see spots reaching into the low 90s and it's going to reach 92 degrees in fairfield, 86 in morgan hill. palo alto reaching 82. 80 in oakland and napa today reaching 87 degrees. so we do have a wide range in temperatures across the bay area, but we also have a cooldown in the forecast. we'll talk more about that and our red flag warning coming up in a few minutes. mike, what's going on right now the commute? kari it's not a red flag warning but it is a note for the

bay bridge, you may have more delay than you expect if you're heading over there about now. too late to warn to you leave the house early unless you have a little bit more time on your prep schedule here. we did have an early backup that formed at the bay bridge, slow off 880 overcrossing. things are sorting themselves out right now. as we look at the span there was early slowing toward treasure island, i believe that's why they turned the metering lights on earlier than usual. the rest of the benicia is a smooth drive. slowing through hayward for the nimitz and south bay a little slowing. contra costa county seeing a separation in the amount of time for the routes through concord and san jose with the first burst starting to ease up. we'll watch for the second coming up in about 20 minutes. back to you. apple's ceo tim cook could be defending his app store in an east bay courtroom today. up next the accusations against apple. plus, elon musk's latest venture into the world of comedy is hosting "saturday night live," but he may need a little

apple ceo tim cook and epic's ceo will be in a courtroom set up for social distancing. epic makes fortnite. it claims apple's app store is an illegal monopoly that takes too much earnings. apple takes a commission up to 30% on purchases made within the app store leading to billions of dollars every year for the company. elon musk looking to the internet for some ideas when he hosts "saturday night live," this coming weekend. musk tweeted out over the weekend a few ideas he had, including irony man, who defeats villain witness the power of irony. another top idea, baby shark and shark tank merge to form baby shark tank. we'll have to wait to see what really makes the cut there as we mentioned he's hosting this weekend's "saturday night live." musical guest miley cyrus. >> a lot of people watch it. trending this morning, do you talk about politics in the office?

the "new york times" reports basecamp recently banned politics at the office but now there's major blow-back. the ceo of the company said political discussions at the office had become a distraction. however, staff members described the move as oppressive and now at least one-third of the company's employees walked out off of the job. other tech companies tried to limit political conversations. as more workers return to work, retailers are saying more people are buying dress clothes as many admit they no longer are fitting into their pre-pandemic clothes. sitting at home eating and working but yet sitting the majority of the day i'm sure. get out there and move, maybe today. >> yes, you can't get away with the stretchy pants at work? >> sweats, not going to be a good look. especially when you walk in, hey, everyone. what? >> hey, i haven't seen you in a while. >> oh, wow, look at you. >> more to love. >> absolutely. of

people? >> absolutely. if you live in the inland valleys and spot like dublin or livermore, we're going to see temperatures heating up today, yes, the earlier the better. here is a live look out there for the morning commute, as people are already back at the office, and we're going to see our temperatures in the low 50s at 7:00, we'll be at 64 degrees at 9:00, that's going to be really nice, 70 at 10:00 and then these numbers start to turn red and you know what that means. it is going to be warm out there, low 80s by 1:00. here's what's going on. we have this high pressure that's been really strong, just off to the west of us but the wind direction around that high pressure is forcing our winds off overso it funnels through our mountains over the central valley, and through the delta, into the bay area, where those winds have been higher. we also have very low humidity, so as that air descends across some of the valley and from the

sierra into the valley, it dries out, and that's what makes that fire danger even worse as it dries out the vegetation, and that low humidity causes any sparks to spread quickly. we have a wide range in temperatures so we'll see some spots like fairfield reach 92 degrees, where it's going to be hot and dry, antioch reaching 91. it's going to be 87 in martinez. compare that to the 80 we'll have in oakland and the low 70s we'll see for a high today in san francisco, our north bay highs will also be very warm, reaching into the low 80s. as we go through the week, this high pressure slowly passes by, keeps it warm and then as we head toward the end of the week, the storm system passing to the north will bring in some gusty winds, more of an ocean breeze, still no rain but at least it will be cooler as we go into the weekend. a lot of us are making plans for mother's day, plan to get outside. look at how beautiful it's going to we're going from the mid to upper week, and san

francisco will be cool going from 72 today to some low 60s by the end of the week. mike, you're watching the roads, what is going on with the commute? >> kari, we're looking at police activity over in pinole. i need to call this out. i circled the general area to the north of 880 or sorry, i-80, correct that, i-80. there's police activity over there near shannon elementary school. be aware. kildair is one of the major roadways through the area to the north side or to the north side of the interstate east shore freeway. we're tracking other areas as well and give you more details in the newsroom. i wanted to call that out as a locator for the pinole area where there's police activity. the rest of the map a smoother drive, expected slowing through concord as the most dramatic there. the bay bridge toll plaza had early metering lights but calmed down to about what you'd expect during this time.

in concord there's a lot of slowing. here are three routes cutting past some of the backup there, keep that in mind. outside of that portion of contra costa county a smoother drive continues for much of the rest of the bay, including the south bay, things move smoothly down there. no second slowing for san jose just yet. reminder also folks, this is may. so this is asian-american pacific american heritage month. i am posting all month sort of tidbits, lesser-known facts things that i didn't know about on all cases, i learned a little bit more like chinatown in san jose, we know san francisco and oakland have chinatowns, right? chinatown san jose you may have asked that. there wasn't one. there were many chinatowns throughout san jose and i've got some great resources for to you start your conversation about this particular phenomenon throughout the south bay's history. there were a lot of locations and there's also on these sites a lot of information about why they had to relocate chinatown and what's there now and you

irma aranda says there was confusion the day her family of 3 got covid-19 tests at the great mall in milpitas with alcala labs. irma says she was charged $240 more than she should have been. a worker on site recommended she follow up for an adjustment. irma did just that by email, by phone and by fax, but she didn't get her $240 back. so she contacted us. we contacted the lab. it did some research then sent us this note right here "given the large volume of tests we have performed, we receive invalid refund claims on a regular basis. this is clearly not the case and we are happy to provide the customer with their requested refund."a $240 win for the aranda family. while on the subject of covid-19 testing, let's talk about travel. some places like hawaii require proof of a negative test before you go. here's the thing. you can't just go anywhere. only tests from select labs are allowed.

because that's power down time. right now at 6:30, fire danger and dry conditions, here we go again, a live look this morning of neighborhoods put on high alert. people have been told to get ready. "today in the bay" continues right now. that was a live look at sfo from the bay. beautiful shot there as we get ready for this monday morning. i'm marcus washington. >> and i'm laura garcia. let's get to the fire conditions that we're talking about. they're already returning to the bay area. we have live tea meteorologist kari hall in a bit. first sharon katsuda is live in contra costa county this morning, sharon, firefighters there are already on standby. we're just in may.

>> reporter: that's right, laura and marcus. they say they usually don't see these very dry conditions until july. now the elevated fire risk is in, the east bay hills and north bay mountains, firefighters in checking out trail conditions this weekend. they also showed us video from last winter where they cleared some problem areas without the risk of not being able to escape during a real fire and firefighters say property owners who clear leaves and create 100 feet defensible space around their property will help prevent wildfires. >> we need to go through the trees and clean them out. i don't think they've been trimmed for years, long before we moved here and take out everything, you know, from the ground up a little ways and just clear out the dead brush and stuff. >> we look at an accelerated fire season. fire danger is relatively slow but if you looked at the hill surrounding our district two weeks ago, all the grass was green and that wouldn't have

carried fire. if you look at it today, all that grass is brown and will certainly burn quite easily. >> reporter: crews worked quickly to put out fttsburg bay. station yesterday, the fire burned about 3 1/2 acres of dryr ass and forced a shutdown of a portion of highway 4 near bailey road. the dry conditions and the smaller fires this past weekend were just a reminder for homeowners to do some maintenance around their homes and the red flag warn solano county is under effect through tomorrow. firefighters across the state are already busy. look at the map. cal fire crews are battling several fires. the biggest is the southern fire burning in san diego right now, containment stands at zero. at least three structures have been destroyed by the flames so

far. for more on the forecast, we want to check with n with meteorologist kari hall. looking at the video, the wind conditions is also a big issue there. >> absolutely. i mean, it's been so windy lately, that's what dried out the vegetation so fast. just a now it's brown and so the winds are still rushing today through the central valley and through the delta and so that's the reason why solano county is included in this red flag warning, where those winds will be up above 25 miles per hour, and we also have humidity levels that are very low. we'll see conditions through tomorrow. all of us in the bay area will have high fire danger. where we see the red flag warning criteria met in solano county is because of that low relative humidity at 15% or less and those frequent wind gusts, so we're watching out for these conditions. you want to make sure that you're also checking out nbc bay area web page, nbcbayarea.com as

walk-in covid vaccination sites open in contra costa county. someone opening at meadow homes elementary school missionary baptist church and this is in richmond through sunday. a new vaccination site in south san jose. set up at the vta santa teresa light rail station in south san jose. expected to be easy toy with a tote vaccinated on their way to work, school or wherever they are headed. it is near san ignacio avenue. vta rides to the station for a vaccine will be free. the free vaccine shuttle provided by ac transit will temporarily return to oakland. the shuttle takes riders to the vaccination site every 15 minutes from the kohl coliseum

b.a.r.t. station 8:00 a.m. through 7:00 p.m. we made it easy for you, head to nbcbayarea.com, click on "race for a vaccine" at the top of the page on our trending bar. 6:36 and just a few hours an true brown, jr., will be laid to rest in elizabeth city, north carolina. he was shot and killed by deputies earlier this morning. as sam brock reports funeral comes as justice and reform comes for police. >> reporter: in north carolina, family members and friends of 42-year-old andrew brown are demanding accountability and answers. over the weekend there were peaceful demonstrations. the investigation continues. friends and fmly are mourning at the same time they are trying to figure out high brown died and we are working in a vacuum of information.

that body camera footage perhaps could prove one way or the other whether or not brown posed a threat to deputies, that is what the pasquotank deputies are main inmaintaining. witnesses say they know what they saw. we'll hear from them on "today." >> thanks, sam. activists plan to march for a man who recently died in the custody of alameda police officers, mario gonzalez was in east oakland resident. the alameda police chief said he suffered a medical emergency as officers detained him on april 19th. that investigation is ongoing. student activists from both cities organized a march and rally starting in fruitvale at 3:00 p.m. drake's beach is closing for the next four months. the favorite summer destination will be offlimits until september because of roadwork and wetland restoration. some of the projects include restoring a large part of

drake's beach parking lot, reconfigured to use the space more effectively and try to improve traffic there. now to our climate in crisis coverage, the local county first to implement new water restrictions a few weeks ago is already looking to increase them. marin county's board of supervisors set to make that move this week. the county is facing historically low reservoir levels and meeting tomorrow with the board they could decide to limit irrigation to two days a week and drip irrigation to three days a week. pools and spas would be covered when not in use. the water reservoirs are at about 50%, the lowest level in 40 years. it is so concerning because we really didn't have a lot of wet weather. any signs of it in the far forecast, kari? >> no, all staying across the pacific northwest to the north of the bay area and so we do

have some warm weather today, as you're getting ready to get the kids out the door, ready for school today. we're taking a look at our forecast in san ramon. we start out with light jacket weather with low 70s. by the time our -- low 50s i should say. it will be in the 70s by the time you pick them up with the sunshine and warming temperatures. across the bay area, we're going to see a range in temperatures from some upper 60s near the immediate coast, low 70s in san francisco to some low 90s for fairfield as well as antioch. now we will have a cooldown for all of us as we head through the week so we'll talk more about that coming up in a few minutes. mike, how is it looking for the commute? >> well you talk about low 90s, kari that, means a lot of sun and what we see in our bay bridge toll plaza shot. we see a lot of sun coming down at theagele that might affect drivers coming in from san francisco heading toward oakland. we also notice the silhouettes of the cars, many fewer cars here. the early backup lightened up at

the bay bridge. it should sort itself up by 7:00. right now lighter at the toll plaza itself. the map will show you no major problems across the bay bridge approach there. slowing through concord typical as well. i want to zoom into pinole where marcus told you about the police activity referencing shannon elementary school they asked for a lock down on kildare so keep that in mind. the rest of the bay typical pattern for your commute. a crash possibly two approaching the dublin interchange might slow things a tad and in the south bay a second burst, a little growth for the slowing in san jose. back to you. >> thanks, mike. 6:41. with demand for vaccines slowing down, the goal is shifting to vaccinating younger people. coming up when kids 12 to 15 to get shots. all month long we celebrate bay area members of our

asian-american and pacific islander community. jerry yang was born in taiwan, moved to san jose at the age of 10. in 1994 he cofounded startup yahoo! while studying at stanford and eventually serving as its ceo. he is a big philanthropist in the bay area. he and his wife donated $75 million to stanford and $25 million to the asian art museum in san francisco. we salute you, jerry yang.

community and it's from comments she recently made to tmz opposing transgender girls competing in girls sports in schools. jenner is the 1976 olympic decathlon gold medalist who later came out as transgender in 2015. she is now running for governor. jenner in the past came down against the trump administration for discriminatory actions against trans people even though she was a trump supporter. the recall for a governor re-election tate announcement will not likely happen until next month. the wheels are spinning for both sides. vice president kamala harris talked about white house support for governor newsom. she and the president both support him 100%. meanwhile, costs for a special election will not be known until next month at the earliest, pegged anywhere from $81 million to $400 million, depending on the amount of covid related precautions they need to take. this morning, restaurants can get some help from the federal government, starting at

9:00 today, they can apply to get relief from president biden's $1.9 trillion covid relief plan. those grants can be for a minimum of $1,000 and go up to $10,000. $26 billion, that's $10 million i should say. $26 billion is allocated for restaurants for the first 21 days, priority of the grants will be given to businesses owned by women, veterans and people of color. a lot of hope in san francisco riding on the cruise business resuming. centers for disease control recently suggested it may allow ships to set sail again this summer. "the examiner" reports that would mean a huge boost in revenues. the port of san francisco has seen a nearly 50% drop over the past year. a shortfall that could reach $100 million over the next five years. nearly 200 cruise arrivals have been canceled in san francisco since the no sail order took effect last march. you could soon be entering

another phase in the fight against covid. following two big stories for you. first san francisco could be enit erg into the less restrictive yellow tier as early as this week. >> as the former fda director shares one of the current vaccines may soon be approved for the use of children as young as 12. we want to bring in "today in the bay's" cierra johnson live following developments. cierra? >> reporter: yes, good morning marcus and laura. both developments are really step forwards in both the fight against covid as well as the desire to return to life pre-pandemic. we're going to start here locally with what's going on with that yellow tier and what exactly that yellow tier means. now the state of california says that san francisco could enter that yellow tier by as early as friday, we're also keeping a close eye on marin county. they, too, have seen a decline in both their cases per 100,000 as well as their positivity rate. so the biggest change within this tier, bars don't have to

serve food and they're allowed to operate indoors at 25% capacity. some other changes you can expect indoor gyms, wineries, tasting rooms can operate indoors at 50% capacity, and as for the live events that capacity is bumped to 67%. now this news of potentially loosened restrictions comes as former fda commissioners share developments when it comes to the vaccine and treating those under the age of 16. so as it stands, moderna is only approved for those 18 and older. pfizer is approved for those 16 and older, but on sunday, the former commissioner of the fda shared developments in the work regarding pfizer in those younger than 16. >> look i'm hopeful that the fda will authorize the pfizer vaccine, the company i'm on the board of has applied for permission to start giving its vaccine to 12 to 15-year-olds. i'm hopeful the fda will authorize that in a short time

sparking here and there. red flag warning in solano county and central valley. the dry northerly wind is where we meet the criteria for a red flag warning but all of the bay area has an elevated risk of seeing fires that could spark and spread quickly because of the setup that we have. we have these offshore winds that are coming in from the northwest and at times northeasterly wind blowing off the coast and as it moves down the sierra into the central valley that air dries out, so the humidity levels continue to drop and by the time it gets here, it just makes the vegetation very crisp and any sparks could spread quickly. going out hiking today look at our south bay forecast, it's going to be nice and cool he mo. 55 degrees at 8:00. i like it when it's cooler, not 80 degrees as the temperatures will warm up, some of us hitting

the low 90s in fairfield and antioch. most 80s from the north bay to the south bay and along the coast we're in the 60s and 70s. no changes in our weather setup except for high pressure that has been keeping it warm and windy, starts to move on, we cool down by the end of the week and still no rain headed our way. so our seven-day forecast does stay dry, our temperatures go from 85 today to 87 tomorrow. warm on wednesday but we transition to much cooler temperature temperatures and thankfully that's here highs in the 70s and san francisco drops back to the 60s. mike, how is the commute rolling? >> silicon valley has no surprises and that's good. we'll take that pretty much any parts of our commute, no surprises there. map i circled 101 slowing through san jose, lighter than many mondays. traffic is ekeing back up in follow. in the tri-valley we have this
