I have reason to believe my company is stealing incentive pay from employees. What do I do?

I work in a warehouse as an order selector, we get paid based on performance. Ex. If I do 500 minutes of work in 350 minutes I get paid for 500 minutes of work.

We use a system called the WINsystem and JDA. Everyday we collectively check our numbers. Recently we have all noticed that our incentive has gone down and the amount of time we are getting for orders have decreased. I used to perform anywhere from 145-170% and now I’m more in the range of 130-140%

From what I have been told by my supervisor incentive wages and the time studies are suppose to be government regulated and they cannot just change the time study or reduce order times on a whim. Is this true?

It’s common knowledge that a large portion of our workforce are illegal immigrants, would an investigation put their jobs at risk?

There is no legal problem with changing performance standards.

When pay is tied directly to those standards changes should be communicated in some way. So you might argue “I’m entitled to pay from the old rubric for that one paycheck it took me by surprise.” But honestly that argument is soft and probably not worth enough to poison the relationship.

I agree that it is easy to say that I am just complaining because I’m not happy with my performance at work but the company has lost a class action lawsuit for what sounded like a very similar situation(I didn’t work there at the time)
