Dennis Hopper's wife accused of having an affair at time of estranged husband's death... while still living under his roof

Dennis Hopper’s wife, Victoria, may have been having an affair at the time of the late actor’s death – while she was still living with him.

Legal documents obtained by RadarOnline reveal that Victoria (nee Duffy) was having an fling with James Cannon Boyce while still living with Hopper, who died last May due to complications with prostate cancer at the age of 74.

Although the Easy Rider star filed for his divorce from his wife of over 13 years in January of 2010, she was still residing in his Venice, California home at the time of his death.

Despite the fact that Hopper filed for divorce because of Duffy’s ‘outrageous conduct’, calling her ‘insane’, ‘inhuman’ and ‘volatile’ – even getting a restraining order against her – the divorce was never finalised.

Unfortunately for Hopper, who clearly wanted to be as far away from Duffy as possible, a judge ruled that not only could she continue living on his property, but that he had to pay her $12,000 a month in spouse support.

Victoria and her now 10-year-old daughter, Galen, have inherited 40 per cent of Hopper’s estate, but that might change in light of this newly revealed information.

Marin, Hopper’s now 49-year-old daughter with the first of his five wives, Brooke Hayward, is suing Duffy over artwork she believes belongs to her; she plans on using the affair as ammunition in her lawsuit.

Marin’s lawyers are attempting to subpoena Boyce so that he’ll be deposed in the proceedings, which Duffy is trying to prevent.  

The documents state that: ‘Victoria had an affair with Mr. Boyce during the time she claims that she and her husband Dennis were happily married and residing together.'

Boyce’s deposition is allegedly being requested because Marin believes he has information about ‘where Victoria is keeping the converted art; what pieces of art she sold; the condition in which the converted art is being kept; Victoria’s statements and/or admissions to Mr. Boyce concerning any of the issues in the pending litigation.’

A hearing has been set for July 12, 2011 to determine whether or not Boyce will actually sit for the court hearing.

It isn’t any wonder that Duffy is nervous about Boyce sitting through a deposition, especially it means she stands to lose any of Hopper’s money, of which she received an estimated £9,958,416 ($16 million).
