Terms with Customers
These terms, in conjunction, with applicable Services Terms, Product Terms and/or Country Terms, apply to a customer's purchase of NetApp services and/or products directly from NetApp or indirectly from a NetApp authorized partner or cloud provider.
- Services Terms - These terms supplement the General Terms and apply to a customer's purchase of NetApp cloud services, support services and/or professional services directly from NetApp or indirectly from a NetApp authorized partner or cloud provider.
- Cloud Services Terms- These terms, along with the General Terms, apply to a customer's access and use of NetApp cloud services.
- List of Cloud Services - This list sets forth the NetApp Cloud Services subject to, and governed by, the Cloud Services Terms.
- Cloud Services – Service Specific Terms - These are service specific terms (e.g., service level agreements) applicable to customers who use and access NetApp cloud services.
- Support Services Terms - These terms, along with the General Terms, apply to a customer’s purchase of support services.
- Professional Services Terms - These terms, along with the General Terms, apply to a customer's purchase of professional services.
- Keystone Staas Terms - These terms, along with the General Terms, apply to a customer’s purchase of Keystone StaaS Services.
- Product Terms - These terms supplement the General Terms and apply to a customer's purchase of products directly from NetApp or indirectly from a NetApp authorized partner (or, where applicable, a cloud provider).
- Hardware Terms - These terms, along with the General Terms, apply to a customer's purchase of hardware.
- Software Terms - These terms, along with the General Terms, apply to a customer's purchase of software.
- Country Terms - These terms supplement the General Terms and apply to a customer's purchase of NetApp services and/or products in specific countries.
- Germany - These terms supplement the General Terms and applicable Services and Product Terms and apply to a customer's purchase of NetApp services and/or products in Germany.
Channel End User Terms
These terms refer to the above/referenced General Terms in conjunction with applicable Services Terms, Product Terms and Country Terms and apply to a customer's purchase of NetApp services and/or products indirectly from a NetApp authorized partner. See above terms.
Additional Terms
These terms apply to a customer's license of NetApp software and related documentation.
These terms apply to customers who purchase the Storage Lifecycle Program.
These terms apply to customers who qualify for NetApp’s Ransomware Recovery Guarantee.
Six Nines Data Availability Guarantee
These terms apply to customers who qualify for NetApp’s Six Nines Data Availability Guarantee.
Customer Data Processing Addendum
These terms apply to NetApp's processing of customer personal data in the course of providing services.
Terms with Resellers
*NOTE: Beginning August 1, 2023, The Partner Sphere Agreement governs all relationships between NetApp and newly authorized NetApp partners, including partner participation in the Partner Sphere Program. The terms below apply to reseller partners that have an active Partner Appointment Letter or Renewal Authorization Letter from NetApp issued prior to August 1, 2023. If you are unsure which terms apply to your partner activity with NetApp, please contact partner@netapp.com or your NetApp representative.
Indirect Channel Partner Terms
The terms govern the relationship between NetApp and a NetApp authorized reseller for the resale and distribution of products and services to end users.
State, Local Government and Higher Education (SLED) Supplemental Terms
Supplemental to the Indirect Channel Partner Terms, the SLED terms apply to NetApp authorized resellers who resell NetApp products and services to SLED end user customers, as well as to prime contractors for resale to SLED end user customers under a valid prime contract.
US Federal Government (FED) Supplemental Terms
Supplemental to the Indirect Channel Partner Terms, the FED terms apply to NetApp authorized resellers who resell NetApp products and services to US federal government customers, as well as to prime contractors for resale to US federal government customers under a valid prime contract.
