Smoking at resorts???

Smoking at resorts???

I am well aware of the smoking ban, just curious if resorts are enforcing it? What resort have you been to since the ban went into affect and were there smoking sections or total ban?

In reading the law, the ban is in public spaces. There are provisions in the law for businesses to have smoking sections. From TravelJudy's post: "This new law requires designated smoking areas to be outdoors where any service or consumption of food, drinks or entertainment is prohibited. The area must be physically separate, consist of less than 10% of the property, and have entrance signs prohibiting minors & warning about danger of exposure in the area."

Dann, I believe you are still allowed to bring in 1 carton/200 cigarettes. I'm not a smoker but I'm sure that there are others on here who will correct me if I'm wrong.

#3 - Yes a certain amount of cigarettes are allowed upon arrival.

MEXICO: Regulations of the General Law for Tobacco Control

***Clarification : 3 Important Questions answered for smokers by Diana Cedillo, deputy director of the National Office for Tobacco Control

#1. What happens if I smoke on the street?

People have raised the question of whether you cannot smoke on the street either, that is, on the roads, avenues or sidewalks.

Smoking in the streets and avenues is not prohibited, but they must be roads that are not classified as 100% smoke- and emissions-free spaces, or streets where large groups of people congregate together.

It's not that you can't smoke on the street, of course you can smoke, but as long as it's not a small space and it doesn't congregate people," explains Diana Cedillo, deputy director of the National Office for Tobacco Control of the National Commission against Addictions (Conadic).

For example, on Madero street, located in the center of Mexico City, you should not smoke because this pedestrian walkway was declared a 100% smoke-free space since 2021. "Being recognized as such, the new provisions of the regulation”, emphasizes Diana Cedillo.

Nor should "the street" be confused with some outdoor spaces, such as parks, where smoking is prohibited.

#2. Can I smoke at a bar, restaurant, hotel or resort?

Yes, if there are Designated Areas that follow very specific regulations.

The General Law for Tobacco Control requires businesses to designate exclusive areas for smokers. These must be located 10 meters from the place where the services are provided and they may not sell or consume food or drinks. In addition, they must not be set with lights and sound, screens and other forms of entertainment and they must be located in open spaces.

Unless a smoking area is provided in these establishments, smoking in unauthorized areas can result in fines and penalties, both for smokers and for businesses that allow it.

The managers of the establishments have the obligation to invite customers try to smoke in areas that are not allowed to put out their cigarettes or any other device for smoking tobacco. If the client repeats the offense, they will have to be invited to leave the establishment and, in case of resistance, the business owners can ask for support from the corresponding authorities.

#3. Can they fine me & what are the fines?

If you smoke in smoke-free streets or with crowds of people, people can be fined, underlines the Conadic official.

“When we talk about these fines, we must remember that they may be subject to economic fines or even arrest fines, which are considered to be 36 hours in detention,” she explains.

The economic sanctions for smoking or lighting any tobacco and nicotine product in smoke-free spaces reach up to $10,374 pesos, according to the current minimum wage.

Going to PV on Thursday the 2nd. How much are they enforcing the smoking ban in PV? Are they fining people on the Malecon for smoking?
