She won't have to pay Michael Lockwood's - at least until a dispute over a post-nuptial agreement is resolved

Elvis's daughter, Lisa Marie Presley, walked out of court with a smile on her face today after a Los Angeles judge denied her estranged husband, Michael Lockwood's demand for $40,000 a month is spousal support.

The couple - who married in 2006 and have twin, eight year-old daughters, Finley and Harper - split up last June and are now embroiled in a bitter divorce and custody battle.

Last week their divorce case took a sensational turn when DailyMail.com revealed that Lisa Marie, 49, claimed in court papers that she had found hundreds of indecent photos and disturbing videos of children on 55 year-old Lockwood's computer. '

'I was shocked and horrified and sick to my stomach,' said Lisa Marie, whose daughters were taken out of the home California's Department of Children and Family Services and are staying with their grandmother Priscilla Presley.

Today, Lisa Marie - dressed in a stylish black pantsuit, white shirt and boots - showed up at Los Angeles Superior Court to challenge Lockwood's demand for her to pay him $40,000 a month in spousal support and $100,000 in attorney fees.

At the hearing, Judge Patrick Cathcart did award musician Lockwood's attorney Jeff Sturman $10,000 a month in attorney fees pending a lengthy divorce proceeding.

Of Lockwood's demand for $40,000 a month support and $100,000 in attorney fees, Gross accused him of 'not looking for work.'

'He could be a car salesman. He could be a music teacher. But he doesn't seem to think he has an obligation to earn money. ……And he hires a lawyer who has a $50,000 retainer.'

Lockwood's attorney, Jeff Sturman, countered, claiming that Lisa Marie's income is more than $5 million a year while his client has 'no means to pay his living expenses whatsoever. He has no income.'

Sturman added that after taxes, the $40,000 a month Lockwood is seeking, 'would be about $24,000 - which would be about enough to provide for his needs.'

But Sturman's pleas for money for his broke client didn't move Judge Cathcart who repeated: 'First we need to resolve the validity of the post-nuptial agreement.'

But he refused to grant Lockwood's plea for spousal support. Judge Cathcart said he wouldn't consider issues like support and custody until after the couples disputed post-nuptial agreement is sorted out.

'The issue of the validity of the post-nuptial agreement needs to be resolved quickly,' said Judge Cathcart who scheduled an April 10 hearing to consider that matter.

That post-nuptial agreement - which the couple signed in 2007 - said that neither party should have a claim on the other if the marriage broke up. But Lockwood is demanding that the prenup should be torn up, saying he was coerced into signing it.

Lisa Marie is refusing to pay him a dime, claiming that her $300 million fortune is gone and her only income is $100,000 a month from her father, Elvis Presley's trust and $4,000 a month from Graceland.

Her attorney, Mark Gross, told the court that Lisa Marie is 'buried in debt,' and among a 'laundry list' of debts, 'she owes over $1 million in taxes for 2015 alone.'

Gross listed over $17,000 monthly expenses that Lisa Marie claims for her children's day to day care. He said that a house she owned in U.K. was 'upside down' in debt and that Lisa Marie 'has no assets.'

Meanwhile, Elvis Presley's granddaughters are under the protective watch of their grandmother after court documents obtained by DailyMail.com revealed the extent of the animosity and vicious charages in their bitter custody battle.

Lisa made the claims in a declaration that she filed in this court's publicly accessible records. 

 'As I experienced during our more than 10-year marriage and as I believe this court will learn (Presley) has great difficulty being honest and she rarely, if ever, accepts personal responsibility for her own wrongdoing,' he added.

'It is particularly distasteful that (she) has placed more value on trying to damage my reputation than on the fact that her false statements may be brought to our daughters' attention.' 

In turn, Lockwood revealed that there are also allegations against his wife. 

'For the time being I will not say anything else about such statements in (Presley's) declaration other than that the allegations against both of us have not been unproven.'

Lockwood, who was married to Elvis' only child for 10 years made the claims in court papers filed on Valentine's Day in Los Angeles Superior Court.

Previously on Friday, it was claimed that the couple's eight-year-old twins were taken into care by California Child Protective Services after Lockwood's computer was searched.

At the time, it was claimed that a court hearing was scheduled for next month to determine their fate, though Priscilla now insists they have been in her care.

Lisa Marie, 49, said police seized 80 of Lockwood's devices and are still going through them to find exactly what is on them. 

'I have no idea what else may be on those devices and fear that there are more and worse images and evidence in these unanalayzed devices,' she said in her filing.

But Lockwood said she broke the rules by revealing the 'unproven allegations' and that she is out to 'destroy' his reputation.

And his lawyer, Jeff Sturman, said that Presley's attorney Mark Gross called his office with a 'threat' that he would go public unless Lockwood abandoned his bid to get $40,000 a month in spousal support and $100,000 towards his legal fees from The King's daughter.

He said he needs the money to pay his legal fees as it is the only way he would be able to afford to 'protect his rights against a very wealth (sic) and vindictive person' like Lisa Marie.

Beatrice Fung, another of Lockwood's lawyers, said a judge made an order in September last year that 'prohibits both parents from discussing the allegations.'

Presley and Lockwood, 55, a musician who has worked with Fiona Apple and Aimee Mann among others, were married in a lavish $340,000 ceremony in Kyoto, Japan in 2006. 

Her first husband, Danny Keough was best man. They separated last June.

Lisa is also mother to daughter Riley, 27, and Benjamin, 24, from her marriage to Keough between 1988 and 1994.

Presley, who claims nearly all of her $300 million fortune is gone, said that she has to pay for two nannies to go along as monitors when her husband visits the children.

DailyMail.com reported exclusively last month that Lockwood was demanding that a post-nuptial agreement that the two had signed in 2007 should be torn up. 

That document said neither party should have a claim on the assets of the other in the event of the marriage breaking down.

In the Valentine's Day papers, Lockwood said Presley is hiding a vast fortune by pretending to be broke. At one time she was said to be worth $300 million.

He claimed she still receives $466,000 a month — $5.6 million a year — from the trust Elvis set up for her before his death in 1977.

He said her tax returns showed that from 2013-2015 she also got more than $4.5 million a year in dividends and capital gains and she receives way more than the $100,000 a month that she claims.

He said in the same three-year period he earned an average of just $55,017 — 'less than one percent' of her income.

Now he said he cannot find work because Presley insisted he concentrate on her career throughout their marriage. 'The music industry changed during that time and I lost most or all of my professional connections,' he said.

'Further, I believe (Presley's) allegations in her declaration will ruin my reputation and it will be difficult or impossible for me to get a job.

Lockwood even slammed his wife over her claim that he had bought the twins an expensive, fully-stocked saltwater fish tank. He said there were just two goldfish in the small tank.

He said the cell phones she claimed he had bought them cost $18 each from Target. 'They play with them,' he said.

'I continue to live a below poverty line existence and need financial assistance to pay my expenses, and my fees and costs,' Lockwood added.

Presley had claimed she was broke and has been forced to move in with her actress daughter Riley. She said she hadn't been on a plane in 18 months and couldn't remember the last time she bought 'clothes and shoes of any value.'

She said Lockwood and a business manager had defrauded her of millions of dollars and she now owes $7.3 million in back taxes and has another $655,000 of other debt, including $212,000 owed on credit cards.

Presley listed 11 bank accounts, mainly held in banks in Jacksonville, Florida. One has just $6.50 in it and another has $9.88. The amounts total nearly $105,000.

In her filing, Presley mentioned only Coes Hall, her home in Sussex, England, saying it was worth just $2 million, while she owes more than $5 million on it.

But Lockwood said she 'failed to disclose material information and attempted to mislead the Court.'

He said she has been paying for five other homes, three in California, one in Tennessee and one in Hawaii.

Daily Mail.com has reached out to Lisa Marie's representatives and her lawyer Mark Gross. Neither returned the calls.
