[1] With the exception of those parts falling under urban areas, subfling will coincide with the constituencies under </Nobody> </Nobody> 89 of the constitution of Kenya. [2] Sub-counties will be headed by a sub-county administrator, appointed by a County Public Service Board. [3] Under the former constitution of Kenya, the provinces of Kenya were subdivided into a number of districts (wilaya). In line with the restructuring of the national administration to fit into the decentralised state system introduced by the 2010 Constitution, which entered into full force after the March 2013 elections, the 8 provinces and their administrators and districts were replaced by county county administrative boards, while previous districts that existed from 2013 were reorganized as subcounty counties and had deputy commissioners appointed over them. [9] The creation of new districts has been criticized by opponents for being a waste of money and a populist attempt to please the local population. However, the government says that new districts bring services closer to the people and will provide security. The judge stated that the districts were created in complete disregard of the law. As a result Kenya had only 46 legal districts (excluding Nairobi with its special constitutional status as capital of the country). [11] Following the March 2013 elections, these 46 districts – along with the city of Nairobi – make up the 47 counties that Kenya is now divided into administratively, and they are also the 47 constituencies for the national senate elections. All the former districts have disappeared (as have the previous 8 provinces whose decentralization was transferred to the new 47 counties), and are now regarded only as sub-counties, without autonomy; they are used in urban areas for a limited organisation to provide public services locally. These remaining sub-counties are transitional and could be replaced by more efficient cooperative structures that group local services in organised cities and their surrounding cities, either for specific missions or for temporary plans; so they can be deeply reorganized or disappear at any time. The remaining sub-counties are already not consistent with the subdivision of the new 47 counties in election-only parishes (based on resident population, in order to determine the number of selected seats for each county in the national senate.
