USPTO asks Federal Circuit to Vacate, Remand 101 Case to Board in Light of Berkheimer

Yesterday the United States Patent and Trademark Office (USPTO) filed a Director’s Unopposed Motion to Vacate and Remand in In re Intelligent Medical Objects, Inc. After the decision of the Board the Federal Circuit decided Berkheimer, which Director Iancu believes requires the Board’s original decision to be vacated and reconsidered in light of both Berkheimer and USPTO guidance relating to Berkheimer.

  • Helsinn: Dueling Questions

    I don’t know what the Supreme Court thinks of alternative statements of the question presented — but it has become a regular practice of parties opposing certiorari to restate the question in an attempt to shift attention of the court.

    The pending petition in Helsinn is on point.  Compare the question presented in the petition with its complete restatement by the opposition:

    Petition: Whether, under the Leahy-Smith America Invents Act, an inventor’s sale of an invention to a third party that is obligated to keep the invention confidential qualifies as prior art for purposes of determining the  patentability of the invention.

    Opposition: Whether this Court should review the Federal Circuit’s factual conclusion that Helsinn’s sale agreement with a third party publicly disclosed its claimed invention “in detail” (Pet. 33a) more than a year before it filed  its patent application, thus triggering the “on sale” bar on patentability set forth in 35 U.S.C. §102(a).

    [Docket with Briefs] The difference between the two is typical — with the petition asking the court to focus on an important question of law and the opposition focusing on already-decided factual minutia.

    El “acceso a los recursos genéticos” y “la participación justa y equitativa de los beneficios que provienen de su utilización” han atribulado las trece Conferencias de las Partes del Convenio de las Naciones Unidas sobre la Diversidad Biológica(CDB), que entró en vigor en 1993. La expresión entre comillas se conoce por sus siglas en inglés como “ABS”. Es el tercer objetivo del Convenio, entrelazado con los primeros dos, que son la conservación y el uso sostenible. A pesar de 25 años de esfuerzos y una bioeconomía de casi un trillón de dólares, pocos son los contratos de acceso que han sido celebrados. De esos pocos, los beneficios monetarios son tan bajos que las partes contratantes (y otros actores) son reacias a divulgarlos, bajo la excusa de “confidencialidad por sensibilidades comerciales”. La ley brasileña de ABS de 2015, que entró en vigor el 6 de noviembre de 2017 por ejemplo, permite que las regalías de las ventas netas sean tan bajas como la décima parte de uno por ciento. En palabras de un erudito jurista, los Usuarios pagan “una miseria por la biodiversidad”.

    Appellants were generic drug manufacturers who filed Abbreviated New Drug Applications (“ANDAs”), seeking approval for generic versions of Vimpat®. As a result, the Federal Circuit affirmed the district court’s ultimate conclusion that the asserted claims were not invalid.
