In other news: Former Nebraska Rep. Jeff Fortenberry indicted again for lying to FBI; charges filed in DC https://omaha.com/news/state-region...de93433e1a.html After a federal appeals court reversed his convictions last December, former Nebraska Congressman Jeff Fortenberry again faces federal felony charges for allegedly lying to the FBI to conceal foreign campaign contributions. Tuesday's two-count indictment against Fortenberry, filed in the District of Columbia, charges him with falsifying and concealing material facts and making false statements. The charges stemmed from Fortenberry receiving an illegal campaign donation from billionaire Nigerian businessman Gilbert Chagoury at a 2016 fundraiser and then allegedly lying about the donation during later interviews with FBI agents. Fortenberry was convicted by a jury in Los Angeles in 2022 on one count of concealing conduit campaign contributions and two counts of lying to federal agents, all felonies. Late last year, the 9th U.S. Circuit Court of Appeals agreed with Fortenberry's argument that holding the trial in California constituted an improper venue, finding the trial should have taken place in Nebraska or Washington, D.C. After the prior convictions were reversed, prosecutors in D.C. had until July 18 to file new charges. Fortenberry's spokesperson, Chad Kolton, told the Lincoln Journal Star Thursday the case is an example of "overzealous prosecution." "Retrying it in D.C. just highlights the prosecutors' vindictive obsession with destroying a good man�s life," Kolton said. "Federal prosecutors should have better things to do than force a distinguished former public servant to incur massive additional legal costs despite already having resigned his office and performed his sentence from a conviction that was ultimately overturned." Fortenberry resigned shortly after the verdict. His congressional seat currently is held by Rep. Mike Flood, R-Neb., who won a special election in 2022 to complete Fortenberry�s term and then was re-elected to a full two-year term.
