Effective immediately, the Avery County Register of Deeds office is limiting public access to our Land Records and Vital Records. We do not know how long these restrictions will be in place and regret having to implement these new procedures but do so with the health and safety of both our customers and staff in mind. REAL ESTATE RECORDING/VAULT ACCESS:
We strongly recommend law office to utilize electronic recording. This offers the quickest and most efficient process for recording.


If you prefer to submit a paper document please call our office for instructions.


Mail-in, FedEx and UPS delivered recordings will continue as normal.


Online Document searches should be done on our website. If you need assistance please call our office.


VITAL RECORDS REQUEST:
We recommend the public to order certified copies of birth, death and marriage certificates through our website. All requests will be processed and mailed out the same day or the following day, depending on time of submission.

You may send us a request by mail along with the fee, copy of your photo ID and a self-addressed stamped envelope.

If you just need a copy of a vital record please call or office for assistance.

For out of county Birth Certificates contact the county of birth. We will not be providing out of county birth certificates at this time.

Funeral Homes should submit their request by fax at 828-733-8261.


MARRIAGE LICENSES:
BY APPOINTMENT ONLY.Please call the office to schedule the appointment. Only the applicants will be allowed in the Courthouse. The application is available on our website and should be filled out prior to the appointment.


NOTARY OATHS/FILING MILITARY DISCHARGE:
BY APPOINTMENT ONLY. Please call the office to schedule the appointment.


The Register of Deeds Office records all land transactions, birth, deaths, and marriages that occur in Avery County.

Office Hours:
Monday - Friday 8:00 a.m. to 4:30 p.m.
Documents are recorded 8:00 a.m. to 4:15 p.m.
Marriage Certificates issued on 8:00 a.m. to 4:00 p.m.

The Register of Deeds Office acts as a recording office only. North Carolina General Statutes specifically prohibit the Register of Deeds or the staff from practicing law. We are unable to supply legal forms, provide instructions of drafting or completing forms, or answer questions regarding the legal consequences of instruments filed. We advise you to consult an attorney if you have any legal questions.
