The tale of Judge Tomasz Szmydt’s unexpected resignation in Belarus exposes the intricate web of political intrigue, judicial ethics and foreign influence shaping Poland’s judiciary, as well as the challenges the European Union faces to uphold the rule of law.

On 6 May 2024, Poland was jolted awake by the unexpected news that one of its judges, Tomasz Szmydt from the Administrative Court in Warsaw, was holding a press conference in Minsk, the capital of Belarus.

He announced his resignation, citing the “pro-Western hostile stance of Poland against Belarus and Russia”, and that he seeks asylum in Belarus.

This sudden turn of events, where the Polish rule of law crisis and the security situation in the region intersected, left many questioning the extent of Belarusian influence in the country and how to safeguard the judiciary from foreign interference.
