Motion denied to dismiss murder count against KVSP inmate

BAKERSFIELD, Calif. (KGET) — A judge on Wednesday denied a defense motion seeking to dismiss a count of first-degree murder against a Kern Valley State Prison inmate accused of killing his cellmate in 2021.

In denying the motion, the judge noted the cellmate of Robert Ambrott Hernandez had broken bones in his throat and multiple skull fractures.

Also, prosecutor Cole Sherman pointed out a shoeprint was found on the throat of the cellmate, Jose Aviles, and he’d been wrapped in a blanket, a towel surrounding his head.

Aviles, 26, died Sept. 9, 2021, of multiple blunt force injuries, according to coroner’s officials.

Hernandez, 28, was charged last year. He has a hearing Thursday to determine if attorneys are ready to proceed to trial, court records show.
