Nick Carter Now Says It's 'Factually Impossible' for Sexual Assault Accusations To Be True

Nick Carter's legal troubles involving sexual assault allegations made against him are far from over — and now, there's been a new update to the case. This week, Nick filed legal documents requesting a summary judgement and a hearing from the court. Though Nick has maintained his innocence from the beginning, now he's going so far as to claim it would be "factually impossible" for things to have happened the way his accuser said they did.

Nick is facing accusations from multiple people, but this case involves one accuser in particular.

According to legal documents obtained by People, Nick is requesting a summary judgement for Shannon Ruth's claims that he is guilty of inflicting "sexual battery, intentional infliction of emotional distress, and negligent infliction of emotional distress" on her.

Ruth accused Nick of sexually assaulting her on a tour bus in 2001, when he was 21 and she was 17.

Nick says it's 'factually impossible' for him to have assaulted Ruth.

The motion names the @ElaineMoo Twitter account, actress Alexa Nikolas, along with singer Melissa Schuman, who accused Nick of rape in 2017, and her father, Jerome Schuman. The document was filed on May 7 in Nevada.

Nick said he has evidence that her claims can't be true.

In the filing, he said his security personnel and band management said he did a "quick out" that night, which means he left as soon as the concert was over. Additionally, a friend, Susan Riggs, said she "personally observed Carter exit the venue, board his tour bus and immediately drive away."

The motion claims that Ruth's claims are 'perjurious.'

"Carter is entitled to summary judgment in this case and should not be forced to proceed to trial in a matter where the plaintiff has failed to produce a shred of reliable evidence to support her claims," the paperwork read, per People.

The filing continued, "Based on the actual and significant evidentiary record, Carter did not rape Ruth and her moving target story does not create a genuine issue where a reasonable jury would return a verdict in her favor."

Ruth has released a statement about Nick's latest filing.

A statement released to People via her attorney, Mark Boscovich, read, "Ms. Ruth disagrees with much of the information that is contained in Mr. Carter’s motion for summary judgment. She looks forward to being able to express her side of the story in her opposition."
