Following the Earl's death in 1810 the Committee for Privileges looked into the validity of the Earl's first marriage in 1785 (there was no argument that the second marriage in 1796 had taken place at Lambeth Church, co. Surrey in 1796 - interestingly the register styles them "Bachelor" and "Spinster" respectively). The Countess testified on oath that the first marriage had taken place at Berkeley. However the entry in the register was not only out of place but also mainly in the handwriting of the Earl himself. Consequently in 1811 the claim of the eldest son to succeed his father as Earl of Berkeley was not allowed by the Committee for Privileges on the grounds that the alleged marriage of 1785 had not been proved. The Earldom became dormant and was not successfully claimed until 1891.

He was the eldest legitimate son of his parents, being born a few months after their 1796 marriage. He never claimed or established his right to the Earldom. On his death the Barony of Berkeley, being a barony created by writ, passed to his niece Louisa Mary Berkeley as the heir general of the body of the 1st Baron Berkeley; the right to the Earldom of Berkeley and the Viscountcy of Dursley passed to his cousin, George Lennox Fitzhardinge Berkeley, as heir male of the body of the 1st Earl of Berkeley.

On the death of the 8th Earl of Berkeley the Earldom of Berkeley and Viscountcy of Dursley became extinct. Berkeley Castle passed to a junior line, the Berkeleys of Spetchley, co. Worcester, who descend from a younger son of the 1st Baron Berkeley. The new owner of Berkeley Castle, Capt Robert George Wilmot Berkeley, of Spetchley Park, co. Worcester (b. 23 Apr 1898; d. 1969) was the 13th cousin in the male line of the last Earl of Berkeley.
