深水埗區議員、大律師劉偉聰近日接受本台專訪,談及他對現時香港司法制度、國安法下的香港的一些看法

對於近日行政長官林鄭月娥指香港並沒有三權(行政、司法、立法)分立,劉偉聰議員認為三權分立就猶如一個「光譜」,不是有或無的問題,而是有多少。劉議員在訪問中指香港現時行政和立法是「圍威喂」,當建制派把持立法會,而建制派「睇林鄭頭」,林鄭則「睇上邊頭」,導致行政和立法串連在一起,最後結果就是很多有問題或者在常人眼中無法理解的法案在立法會通過。他指為何大陸無法治,是因為大陸一黨獨大,沒有任何機關能將它制衡,不像歐美能夠互相制衡、監察

問到劉議員對於《港區國安法》的看法,他認為《國安法》中的部分法例能夠以言入罪,嚴重削弱香港的言論自由。身為七月一日光時旗電單車案被告唐英傑先生的代表律師,劉偉聰認為「光復香港 時代革命」在每個人的心中都有不同的意思,「光復香港 時代革命」並不一定代表意圖將香港分離出去。「光復香港」可以代表很多含義,例如一九九七年香港回歸中華人民共和國亦可以是「光復香港」,「時代革命」同樣也可以代表很多含義,例如「IT革命」、「工業革命」。劉偉聰表示在他心中「光復香港 時代革命」是「假大空」的話語,而「假大空」的話語不應入罪。劉偉聰批評執法機關將這些「假大空」的話語作為證據拘捕市民是一種濫捕的行為

對於法官何俊堯日前被多人投訴其審理案件不公,現時八宗投訴有六宗已完成調查,六宗投訴均不成立,劉偉聰認為這些投訴的背後是部分建制派議員「搞事」,更點名批評周浩鼎和葛珮帆等人無的放矢

劉偉聰議員在專訪中亦批評警方的一些拘捕行動根本就是濫捕,在他處理的反修例案件中很多都是證據不太足夠,難以入罪,表面證供亦都不清晰

最後,劉偉聰議員希望香港人能夠在亂世中保重,籲年輕人保留有用之軀,純粹街頭抗爭不是唯一出路。他表示,無論是「雨傘革命」或者「反修例運動」,大家追求的都是一個自由的社會,離開香港抑或是留在香港的人都是值得尊重的

He commented on the recent legislation of
the National Security Law as literary inquisition and does a huge blow to free speech in Hong Kong. As a lawyer of a defendant charged under the security law, he sees it in another perspective. ““Liberate Hong Kong” can have different meanings among different people, some might even see Hong Kong’s hand over as a liberation”, he said. From his perspective “Liberate Hong Kong” is a vague term which should not be inquested on.

With a spike in complaints related to magistrate Ho Chun Yiu and a majority deemed invalid, he commented on it as trouble making by the pro-establishment camp.

And with more and more arbitrary arrests made by the police and weak prima facie provided on court, he hoped that Hong Kongers should play the game safe and that large-scale protest are not their only way to expressing themselves.
