THE LANCASTER COUNTY DEPUTY ATTORNEY REVEALING MONTHS AGO, PRISCILLA JOSEPH SAID SHE DIDN’T WANT TO TESTIFY. I HAD RECEIVED AN EMAIL FROM MISS JOSEPH ON FEBRUARY 17TH TO MYSELF AND MR. BRENNAN, INDICATING THAT MISS JOSEPH WAS NOT INTENDING TO TESTIFY IN THIS CASE. THE STATE BELIEVES PRISCILLA JOSEPH IS NOW LIVING IN ARIZONA AND THROUGH JUDICIAL POWERS, ATTEMPTED TO GET HER BACK TO NEBRASKA. SO WE DID ISSUE AN OUT OF STATE SUBPOENA IN ORDER TO ENSURE HER APPEARANCE AND AFFIDAVIT SHOWS ARIZONA LAW ENFORCEMENT WENT TO THE HOUSE. JOSEPH WAS BELIEVED TO BE OUT ON FOUR SEPARATE DAYS. NO ONE EVER CAME TO THE DOOR OR RESPONDED TO A CALLBACK NUMBER THAT WAS LEFT THERE. DESPITE SEVERAL ATTEMPTS BY THE AUTHORITIES IN ARIZONA, SHE WAS NOT ABLE TO BE SERVED WITHOUT PRISCILLA JOSEPH. THE STATE’S CASE MISSING ITS KEY WITNESS. SO AT THIS TIME, I AM MOVING TO DISMISS WITHOUT PREJUDICE AT STATE’S COST. AND FROM MICKEY JOSEPH AND HIS ATTORNEY.
