State v Ibarra: Luis Ibarra, a registered nurse, was charged with and convicted of rape in the second degree after he raped a patient while she was immobile and recovering from spinal surgery. Ibarra was sentenced to 102 months to life. He appeals alleging among other things that the court abused its discretion by denying a mistrial following testimony of his ex-wife; the court erred by concluding he opened the door to having been advised about sexual contact with patients; and several community custody conditions are not crime-related and violated his right to privacy.
