Morena Baccarin will have to pay her estranged husband Austin Chick more $23,000 a month for the foreseeable future, a judge ruled Thursday.

Baccarin, 36, was the family’s breadwinner during their three-year marriage and Chick, an independent writer, director and producer, is currently unemployed. At a custody hearing in Los Angeles on Thursday, she was ordered to pay him $20,349 each month in spousal support, and $2,693 in child support until their son Julius, now 2, turns 18, according to court papers obtained by PEOPLE.

In September, a Los Angeles judge allowed Baccarin to move Julius with her to New York, where she shoots Gotham.

Baccarin is now expecting a baby with costar Ben McKenzie, 37.

On Thursday, the actress asked that the amount she pays to rent an apartment for Chick, 44, in N.Y.C. to live in when he visits Julius be deducted from her spousal support, but the judge denied her request.

“In my opinion, Ms. Baccarin got the shortest end of the stick,” divorce lawyer Michael Stutman, head of the family group at Mishcon de Reya New York, tells PEOPLE.

“Not giving Ms. Baccarin credit for the N.Y.C. apartment she had been paying for was a slap at her,” adds Stutman, who is not involved in the case. “Clearly there was a lack of an enforceable agreement if it wasn’t brought up in the spousal support decision.”
