Delhi riots: HC grants ex-AAP councillor Tahir Hussain bail in 5 cases; to remain in custody

Hussain will remain in custody since there are other cases registered against him including the Delhi Police’s "larger conspiracy" case

The Delhi High Court on Wednesday granted bail to former AAP councillor Tahir Hussain in five cases related to the 2020 Northeast Delhi riots.

A single-judge bench comprising Justice Anish Dayal of Delhi High Court pronounced the bail order for Hussain, who has been booked under the charges of rioting, mischief by fire, and criminal conspiracy, among others. The bail has been granted subject to certain conditions, the high court said.

Hussain will remain in custody since there are other cases registered against him including the Delhi Police’s “larger conspiracy” case wherein he has been booked under the stringent Unlawful Activities (Prevention) Act.

In October 2022, a Delhi court had framed charges against the former AAP councillor, his brother Shah Alam, and four other men in one of the Northeast Delhi riots cases, while stating that the mob had a “clear-cut objective in mind, to kill and harm Hindus.”

In February, senior advocate Salman Khurshid, appearing for Hussain, had argued before the court that his client has not been named in the initial witness statements, even though his name features in the subsequent witness statements. He argued that all the co-accused in these cases have been granted bail. “I’m (Hussain) the only one left,” Khurshid had said.
