2. Privacy

2.1. Any personal data of the User collected by Polaris shall be treated in strict respect and observance of applicable legal rules.

2.2. We intend for the Users to be aware of our privacy and data processing rules regarding User information gathered and processed through the Website. The privacy policy and conditions of the Andre Silva Website (hereinafter “Privacy Policy”) are an integral part of these Terms and Conditions and include rules on the use of cookies, storage mechanisms and access to information can be accessed here. 4. Reserved Area

4.1. The André Silva Website offers a reserved area that may be accessed after User registration. Access to and registration in the reserved area is subject to the User providing certain required information in the registration process. The User may also additionally provide other information of voluntary nature in the registration process.

5.3. Breach by the User of clause 5.2. above implies civil and criminal liability, without prejudice to 3.4 above, and the destruction of any copies, reproductions, transmission or any derivative or equivalent works made by the User.

5.4. If the User becomes aware of any unlawful use of the Website or its respective contents, the User shall immediately notify Polaris of such facts by any of the contact methods referred in 1.2 above.

Polaris will endeavour, within its power, to include updated and accurate information, when possible, but it makes no representation or warranty in this regard. Furthermore, Polaris shall have no obligation to update the content of the Website. Please bear in mind that the information provided in the Website may be inaccurate, contain spelling mistakes or be outdated.

10.1. Polaris reserves the right to, at any time, modify or amend the Terms and Conditions and any relevant amendments will be notified to the Users through the Website by notices published on the Website and the User’s consent to such amendments will be requested. User should consult the Terms and Conditions on a regular basis.

10.2. If the User does not accept the amended Terms and Conditions, User should deactivate the respective reserved area account, if applicable.

10.3. In the event of conflict between these Terms and Conditions and any future version of the same, the latest version will prevail over any previous versions.

3. Processing of Personal Data

3.1. Without prejudice to the following paragraph, by registering in the André Silva Website, the adhering user (hereinafter “you” or “User”) expressly consents to the processing by Polaris of the following categories of data: name, telephone number, e-mail address, password, session ID and data and time of access; furthermore, the computer IP address or that of the mobile device through which access to the André Silva Website is made may be collected. Personal information provided by the User to Polaris by email, telephone, fax, mobile messages or through any other means of communication shall also be processed.

3.2. All navigation and registration in the Website involves the use of Google Analytics, and, as a result, involves the processing, in an aggregate manner, by Polaris and Google, of the following data categories: geographic location of access (continent, country, city), age, gender, language, interests (for example, movies, sports, music, TV), device though which access is made (for example, mobile device, tablet or desktop), navigation behavior (for example, whether a new user or a returning user, average length of session, average length of time on each page, including in the reserved area) and contents accessed in the reserved area. 3.3. For purposes of the Privacy Policy, any personal data or information regarding the User processed by Polaris shall be referred to generically as “Personal Data”.

3.4. The collection of the User’s Personal Data is made through the Website’s access portal, in andresilva10.com, with the User’s consent, which when required by applicable law shall be express and prior.

3.5. Some of the Personal Data is required information and is duly identified and, in the event of failure or error in providing such data, access to the André Silva Website will not be available.

3.6. By registering in the André Silva Website, the User expressly agrees to the processing of the Personal Data for the following purposes:

4. Consent

4.1. The User may withdraw, at any time, the consent given pursuant to 3.4 above in the manner set out in 5.4 below regarding right of access.

5.5. Without prejudice to the previous paragraph, Polaris shall eliminate Personal Data within no more than 1 (one) month following the User’s cancellation of registration in the André Silva Website or after definitive interruption of the Website or, in the event there is no cancellation, within a maximum of 18 (eighteen) months after the User’s last access to the account.

6. Minors

8. Changes to the Privacy Policy

8.1. Polaris reserves the right to, at any time, modify, amend or update the Privacy Policy, safety and protection of data and any relevant amendments will be notified to the User through the Website by notices published on the Website and the User’s consent to such amendments will be requested. When legally requires, the User consent to the amendments will be required. Refusal of consent may imply, depending on the case, inability to access the Website or the reserved area.

8.2. In the event of conflict between this Privacy Policy and any future version of the same, the latest version will prevail over any previous versions.
