Dred Scott
His wife and two daughters were slaves of a US military doctor
Traveled around with the owner into free areas
After Emerson's death, he sued for freedom for him and his fsmily
Decision
Taney ruled:
1. African Americans (regardless of if they were free or slave) were not citizens and so could not sue in court
2. Slaves were considered property and therefore could not be taken away without "due process" (congress couldn't prevent southerners from moving slaves into the territories and owning them there)
3. The Missouri compromise was unconstitutional. Congress couldn't regulate slavery in territories
Impact
Tensions increase between the north and the south
Many northerners became abolitionists
Douglas was against it. in his "Freeport Doctrine" believed territories could not enforce the decision if they didn't want to
Split the democrats along sectional lines (guaranteeing a republican win in the election of 1860)
In order for African Americans to become citizens, a new court case or amendment would be needed
