Customer: What is the "standard visitation schedule" in Arkansas for a joint custody father when the mother has actual physical custody? The child is 22 months old. The stated visitation was court ordered in December 2011 and to be followed beginning when the child turned 18 months old.

Hi,

My name is XXXXX XXXXX I'd be happy to answer your questions today.

The standard visitation schedule doesn't really work until the child is five years old - it has provisions that talk about school holidays, and things like that. The standard order for an older child is Wednesday, plus alternating weekends and holidays. The father always gets Father's Day, and the mother always gets Mother's Day (for the expected reasons). Summer vacation is divided into six week blocks.

With a very young child, it's common for judges to deviate, and they do have some discretion. The judge may choose not to allow overnight visits at first, or could start with less visitation and eventually work his way up to more time with the non-custodial parent. But the judge has a lot of discretion - there isn't the same set standard as there is when the children get to school.

If there is currently an order in place, and one of the parents is refusing to follow it, the other parent may be able to have the order enforced by filing a Contempt Motion in the original court. If the current schedule just isn't working, and there has been a material change in circumstances, either parent can file a request to modify it.

I was wanting specifics, ie. every other weekend, one night during the week, every other holiday, etc. The judge ordered this type schedule to begin at the childs turning 18 months old, not 5 years old.

Again, what is the "standard visitation schedule" (as is stated in the court order) for Arkansas? If is standard, then is consistant and the same for all that fall under such an order. Therefore this should be able to be stated as to it's specifics.

If it's simply a matter of more money to get a specific "standard" answer, let me know.

Regards,

Colton Reeves

"Standard" does not mean "mandatory and required in all cases." I gave you the standard order, which, again, is designed for children at least five years old, but can be ordered for younger children. The judge has some discretion to deviate with younger children, if he believes that it's in the children's best interests.

What I said was "The standard order for an older child is Wednesday, plus alternating weekends and holidays. The father always gets Father's Day, and the mother always gets Mother's Day (for the expected reasons). Summer vacation is divided into six week blocks." This site lays it out in a little more detail, but those are the basics.
