• Henry Mildmay, de jure 16th Baron FitzWalter (d. 1662) claimed the Barony of FitzWalter in the House of Lords in 1660.
• Benjamin Mildmay, 17th Baron FitzWalter (c. 1646–1679) petitioned the House of Lords in 1667 for a writ of summons and a decision given in his favour by the Privy Council in 1669.
• Charles Mildmay, 18th Baron FitzWalter (1670–1728)
• Benjamin Mildmay, 1st Earl FitzWalter, Viscount Harwich, 19th Baron FitzWalter (1672–1756) On his death the Earldom of FitzWalter and the Viscountcy of Harwich became extinct but the Barony of FitzWalter fell into abeyance amongst the issue of his aunt, Hon Mary Mildmay, the only sister of the 16th and 17th Barons FitzWalter.  The abeyance was terminated 30 Sep 1924 after nearly 169 years in favour of one of the co-heirs:
