The CLE will discuss recent developments at the Court, including the fall-out from key decisions of last term, and recent high-profile discussion of the Court. In recent years, information exchange has become a priority for both government antitrust enforcers and private antitrust plaintiffs. Across industries, business practices such as benchmarking and algorithmic price setting are under increased scrutiny. And the withdrawal of agency guidance providing information exchange “safe harbors” has only increased the uncertainty surrounding these common practices. This CLE will cover the antitrust theories of liability that arise from information exchange, provide lessons learned from recent enforcement actions, and provide tips to know when to call antitrust counsel for guidance.

This CLE will demystify the political and economic responses of the US, UK, EU, and their allies to the key geopolitical conflicts that continue to spark around the world in 2024—from Russia to China, semiconductors to shipping, and everywhere in between. It will help companies navigate the complex web of multilateral economic sanctions, export controls, and supply chain restrictions; and forecast the increased enforcement trends by regulators worldwide so companies can anticipate and mitigate future risks.

This session will provide a survey of key issues and trends impacting the fintech and digital assets community as well as the future opportunities and challenges presented for these financial products and services. It will cover third-party risk management issues, bank-fintech partnerships, and an overview of recent enforcement actions involving Fintech and Crypto companies. It will also highlight current litigation issues and risks, as well as outline the areas of primary focus by regulators in this area, particularly the SEC, prudential banking regulators, NYDFS, CFPB, and others. The presentation will also include a discussion of recent appellate and Supreme Court activity affecting the cryptocurrency industry.

On May 13, 2024, the Federal Energy Regulatory Commission (FERC) issued its long-awaited final rule on regional transmission planning and cost allocation, Order No. 1920. The final rule’s release follows a notice-and-comment period that drew over 600 comments from interested parties, amounting to over 30,000 pages from nearly 200 stakeholders—the largest record considered in any FERC proceeding, according to FERC staff.[1]
