英國勞工法例給予僱員非常優厚的病假待遇,因此有機會遭到濫用,TYE不鼓勵濫用病假,但你絕對需要了解一下有關方面的勞工權益。
請病假 Taking Sick Leave
Employees can take time off work if they’re ill. They need to give their employer proof if they’re ill for more than 7 days.
員工生病時可請假,若請病假超過7日,須向僱主提供證明,例如醫生紙 fit note / sick note。
若員工請病假少於7日,可通過 self-certification 自我證明生病,而無需向僱主提供醫生證明。
If employees are self-isolating and cannot work because of coronavirus (COVID-19) they can get an ‘isolation note’ online from NHS 111. They do not have to go to their GP or a hospital.
若員工因武漢肺炎須要接受隔離,可到以下 NHS 網頁索取隔離證明 isolation note:
法定有薪病假 Statutory Sick Pay
You can get £96.35 per week Statutory Sick Pay (SSP) if you’re too ill to work. It’s paid by your employer for up to 28 weeks.
合資格人士若因病無法上班,可享有每星期 £96.35 的法定有薪病假,僱主須向僱員支付最多28星期的有薪病假。
You cannot get less than the statutory amount. You can get more if your company has a sick pay scheme (or ‘occupational scheme’) - check your employment contract.
有薪病假不可少於 SSP 金額,但可按照僱傭合約中的 sick pay scheme / occupational scheme 給予僱員更高金額。
To qualify for Statutory Sick Pay (SSP) you must:
• be classed as an employee and have done some work for your employer
• earn an average of at least £120 per week
• have been ill or self-isolating for at least 4 days in a row (including non-working days)
• 被界定為員工,並曾為僱主工作
• 每星期的薪金最少有 £120
• 最少生病 / 自我隔離 4日 (包括非工作日子)

You must usually tell your employer you’re unable to work before the deadline they set (or within 7 days if they have not set one).
You could lose some of your SSP if you do not tell your employer in time.
你必須在僱主設定的限期前通知僱主請病假,若僱主沒有設定限期,你必須在7日內通知僱主。若沒有及時通知僱主,你有機會失去部分法定病假。
You will not qualify if you:
• have received the maximum amount of SSP (28 weeks)
• are getting Statutory Maternity Pay
• are self-isolating after entering or returning to the UK and do not need to self-isolate for any other reason
• 已經享用28星期的法定病假
• 正在使用法定產假
• 返回英國後正在自我隔離,而本身你無須為武漢肺炎外的原因自我隔離
You can still qualify if you started your job recently and you have not received 8 weeks’ pay yet. Ask your employer to find out more.
若你為僱主工作未夠8星期,你依然有機會符合享有SSP資格,你需向僱主查詢。

Employees who are off work sick for more than 4 weeks may be considered long-term sick. A long-term sick employee is still entitled to annual leave.
員工約請病假超過4星期,會被界定為長期患病,但依然可享有法定假期。
Dismissing a long-term sick employee
As a last resort, employers can dismiss an employee who is long-term sick, but before they can do this employers must:
• consider if an employee can return to work - such as by working flexibly or part-time, doing different or less stressful work (with training if necessary)
• consult with employees about when they could return to work and if their health will improve
• 考慮員工能否回到工作崗位,例如提供彈性工作、兼職、擔任不同或較少壓力的工作 (即使需要培訓)
• 諮詢員工何時能夠工作及他們的健康情況會否改善
