State the issue before the Supreme Court in this case.
Was the refusal by police to honor Escobedo's request to consult with his lawyer a violation of his 6th Amendment rights?
What facts of the case were presented to the court?
Escobedo's brother in law was killed. He was arrested (without a warrant) and released about 7 hours later. He was arrested again 10 days later. Police didn't allow him to see his lawyer. Escobedo asked the information obtained without his lawyer to be suppressed in court, which was denied.
What was the decision of the Court? What was the rationale behind it?
The vote was 5-4 in favor of Escobedo because his rights had been violated and the information used against him as evidence unlawfully obtained.
What was the effect of the decision?
The decision made the 6th Amendment more clear; that criminally accused should still be protected under the law and what and what not can be used as evidence. This decision was widely criticized by cops, as it made their job harder.
