Diplomatic Asylum. Former rulers accuse Venezuela of violating Convention

The Government of Venezuela was today accused by former heads of state and government of South America of the Democratic Initiative of Spain and the Americas (IDEA) of violating human rights and the Caracas Convention on Diplomatic Asylum.

In a statement, the leaders of IDEA also expressed concern about the threats to the Venezuelan opposition, particularly the opposition leader María Corina Machado, and its candidate for the July 28 presidential election, Edmundo González Urrutia, assuring that they are "alert" so that the elections are "free, fair, competitive and internationally observed".

IDEA, which represents 27 countries, also says that it has found "that the illegal and arbitrary detention in the dark prisons of the dictatorship" of leaders close to María Corina Machado and "the persecution of members of her national campaign team, who are subject to diplomatic asylum in the representation of the Argentine Republic in Caracas without receiving the respective safe-conducts, which must be granted urgently".

"We highlight and denounce (...) the open violation by the regime of Nicolás Maduro Moros (Venezuelan President) of the provisions of the 1954 Caracas Convention on diplomatic asylum", they explain, also invoking the doctrine of the International Court of Justice (ICJ) and of the Inter-American Court of Human Rights on victims of political persecution.

Among others, the document was signed by Mario Abdo Benitez, Juan Carlos Wasmos and Federico Franco (from Paraguay); José María Aznar (Spain); Nicolás Ardito Barletta, Felipe Calderón and Vicente Fox (Mexico); Miguel Ángel Rodríguez and Luis Guillermo Solís (Costa Rica); Andrés Pastrana, Álvaro Uribe and Iván Duque (Colombia), Eduardo Frei (Chile); Luis Alberto Lacalle (Uruguay); Mauricio Macri (Argentina).

On March 27, 2024, a group of Venezuelan opposition leaders who took refuge in the official residence of Argentina in Caracas declared themselves "protected" by the Argentine government, denouncing the government's "harassment", including the power cut to the diplomatic representation.

"We are six political leaders persecuted by the Nicolás Maduro regime, who have taken refuge in the Argentine embassy in Caracas (...) and since the regime became aware of our presence here, after issuing an arrest warrant, it began harassing the diplomatic headquarters", said Omar González Moreno to Radio Rivadavia OM630, from Argentina.

According to IDEA today, "diplomatic asylum is a humanitarian practice with the aim of protecting the fundamental rights of the individual", in this case Machado's collaborators, who are "prevented from supporting the presidential candidacy of Edmundo González Urrutia".

"We urge the Permanent Council of the Organization of American States to take into account Venezuela's violations of the Asylum Convention and, if necessary, to urge the States parties, in particular Argentina, to file an action before the ICJ", it concludes.
