About the Kern County Superior Court

The Kern County Superior Court, or alternatively the Superior Court of California, County of Kern, has jurisdiction over Kern County, the third largest county in California by land area and the 20th largest in the U.S. The Kern County Superior Court is one of the 58 unified trial courts in California, serving over 900,000 residents who live and work across the 8,161 square miles of Kern County.

In its mission statement, the Court states that its goal is “to provide justice fairly and efficiently for all.”

To fulfill its promise of efficiency, the Kern County Superior Court operates eleven courthouses and program locations across Bakersfield and surrounding cities. The Court is organized into ten divisions, including the Appeals, Civil and Small Claims, Family Law, Interpreter Services, Jury Services, Juvenile, Probate, Revenue Recovery, and Traffic Divisions.

Kern County Superior Court Divisions

Appeals Division

The Appeals Division of the Kern County Superior Court primarily reviews the decisions of the trial court to see if there were any legal errors made in the case. Except in small claims matters, an appeal is not a new trial. The appellate court does not retry cases, consider any new evidence, or reassess conflicting evidence.

Civil and Small Claims Division

The Civil and Small Claims Division deals with small claims, including cases involving up to $10,000 (or $5,000 if you’re a business); limited civil cases, where the amount in dispute is $25,000 or less; unlimited civil cases, which are cases for more than $25,000; abuse and harassment, including domestic abuse, elder abuse, and general harassment; adoptions; civil appeals; eviction and landlord tenant disputes; gender changes; and name changes.

Criminal Division

The Kern County Superior Court Criminal Division deals with criminal cases ranging from minor offenses involving infractions to serious offenses involving misdemeanors and felonies. Vehicular violations handled by the Criminal Division involve offenses relating to DUIs, hit and runs, reckless driving, or suspended license violations.

Family Division

The Family Division deals with legal issues involving divorce, legal separation, nullity, parentage, child custody and visitation, child support, spousal support, family support, domestic violence restraining orders, and elder abuse.

This division offers many services, including family court mediations, dependency mediations, family court investigations, probate court investigations, and supervised visitation providers.

Interpreter Services Division

The Interpreter Services Division ensures that a person with limited proficiency in English language is provided a court interpreter free of charge in all mandated case types, including criminal cases, traffic violations, juvenile delinquency, juvenile dependency, child support, mental health, and domestic violence cases. This division also offers services for certain civil case types, including family law, elder abuse, civil harassment, unlawful detention, termination of parental rights, small claims, and cases that involve custody or visitation of children, conservatorship, and guardianship.

Jury Service Division

The Jury Service Division of Kern County Superior Court is committed to making “jury service as convenient and comfortable as possible.”

Juvenile Division

The Juvenile Division handles matters relating to issues of juvenile dependency, juvenile delinquency, and juvenile traffic citations and/or minor offenses.

Probate Division

The Probate Division has original jurisdiction over actions concerning the issuance of marriage licenses, the estate of deceased persons, the will of individuals, the estate of minors or incapacitated persons, trusts, and involuntary commitments.

Revenue Recovery Division

The Revenue Recovery Division assists people who cannot pay their entire fine at the time of their hearing by arranging an installment payment plan.
