E-9.1 Loi sur les espèces menacées d'extinction and declared by regulation to be endangered; "Minister" means the Minister of Natural Resources. 2 The Minister is responsible for the adminis- tration of this Act. 3(1) The Lieutenant-Governor in Council may make regulations declaring any species or sub- species of fauna or flora to be endangered. 3(2) A regulation made pursuant to subsection (1) may cover specific periods of time and areas of the Province or may be of a general nature. 4(1) No person shall kill, injure, harass or interfere with or attempt to kill, injure, harass or interfere with any member of an endangered species of fauna. 4(2) Notwithstanding subsection (1), the Minis- ter may in writing authorize a deputy game warden appointed under the Game Act to kill a member of an endangered species of fauna. 5 No person shall destroy or interfere with or attempt to destroy or interfere with any member of an endangered species of flora or the habitat of an endangered species of flora. 6 The provisions of the Game Act relating to the powers of a deputy game warden or a special game warden appointed under that Act are mutatis mutandis applicable to this Act. 7 A person who violates section 4 or 5 is guilty of an offence and, on summary conviction, is liable to a fine of not less than twenty-five dollars and not more than one thousand dollars or to imprisonment for a period not exceeding one hundred days or to both, and in default of payment of a fine is liable to imprisonment in accordance with subsection 31(3) of the Sum- mary Convictions Act. 8 This Act or any provision thereof shall come into force on a day to be fixed by proclamation. QUEEN'S PRINTER FOR NEW BRUNSWICK © L'IMPRIMEUR DE LA REINE POUR LE NOUVEAU-BRUNSWICK 2 et que le règlement déclare menacée; «Ministre» désigne le ministre des Ressources naturelles. 2 Le Ministre est chargé de l'application de la présente loi. 3(1) Le lieutenant-gouverneur en conseil peut établir des règlements déclarant menacée toute espèce ou sous-espèce de la faune ou de la flore. 3(2) Un règlement établi en application du paragraphe (1) peut couvrir certaines périodes et régions de la province ou revêtir un caractère général. 4(1) Nul ne doit tuer, blesser, harceler ou déranger, ni essayer de tuer, blesser, harceler ou déranger tout membre d'une espèce menacée de la faune. 4(2) Nonobstant le paragraphe (1), le Ministre peut autoriser par écrit un garde-chasse suppléant nommé en application de la Loi sur la chasse à tuer un membre d'une espèce menacée de la faune. 5 Nul ne doit détruire ou déranger ni essayer de détruire ou de déranger tout membre d'une espèce menacée de la flore ou l'habitat d'une espèce menacée de la flore. 6 Les dispositions de la Loi sur la chasse relatives aux pouvoirs d'un garde-chasse sup-pléant ou d'un garde-chasse spécial nommé en vertu de cette loi s'appliquent mutatis mutandis à la présente loi. 7 Quiconque enfreint les articles 4 ou 5 est coupable d'une infraction et passible, sur déclara-tion sommaire de culpabilité, d'une amende de ving-cinq à mille dollars ou d'un emprisonnement de cent jours au plus ou de l'une et l'autre peine et, à défaut de paiemnt de l'amende, de la peine d'emprisonnement prévue au paragraphe 31(3) de la Loi sur les poursuites sommaires. 8 La présente loi ou l'une de ses dispositions entrera en vigueur à une date qui sera fixée par proclamation.
