If my name is misspelled on a contract is it still valid and binding?
I'm about to sign a contract, but my name is misspelled, the other party says they'll fix it after I sign it. My name is easy to misspell, but still, I'm concerned about it.
People think that there is something magic about the spelling of their name or other identifying information. On Avvo people ask all the time whether a minor misspelling of their name or a transposition of digits on their license plate will defeat a speeding ticket. The short answer is, the misspelling of your name is not like a misreading of a magic spell. If you are a party to the contract and the contract is otherwise lawful, and you mean to sign onto the deal and you do, the misspelling isn't going to have any effect. I don't know why you wouldn't cross out the misspelling and provide the proper spelling wherever the misspelling of your name appears.
Not legal advice, just my two cents. I don't practice law in New Mexico or hold licensure there. This answer draws upon general principles, NOT the law of New Mexico. Consult New Mexico counsel if you need legal advice. I practice in Vermont ONLY.
