stay with msnbc tonight at 9:00 p.m. eastern. the fulton county district attorney bobby willis was prosecuting donald trump in the election interference case. he joins us in an exclusive interview ahead of tomorrow's georgia primary where willis is on the ballot. join us wednesday night right here when nathan wade will be my guest. he resigned as fulton county special prosecutor in the trump case in march following a judge's ultimatum that willis could only keep the case if wade stepped down. tune in for that. that is tonight's read out inside with jen psaki starts next. . we are rapidly approaching the conclusion of donald trump's criminal trial in new york.

and let's just say that a lot happened today in lower manhattan. lucky for us, we have the perfect person to talk about it with. diane perry has been serving as counsel for michael cohen during the trial and has given an interview about the testimony . we will talk to her in a moment. her client, michael cohen, of course is the star witness in the case and he returned to the stand today for a third day of cross-examination. from the beginning, we have known that putting michael cohen on the witness stand was a high risk and high reward proposition for the prosecution. on one hand, he is the central player. after all, he paid stormy daniels out of his own pocket pick he said he did it at donald trump's direction and said donald trump was fully aware of the plan to cover it up. those are the key details. at the same time, cohen is a convicted felon who pled guilty to lying to congress and making false statements to a bank. not to mention he spent over a

decade doing trump's dirty work. and the credibility issues are why the prosecution used the 20 witnesses, 20 of them, that had cohen corroborating the story before they put him on the stand and it is what trump's defense team single-mindedly sought to discredit him even on details that might not be crucial to rebutting the prosecution. for that reason, the defense may think that they racked up a big victory for themselves today because during the cross- examination this morning, michael cohen admitted that he stole from the trump organization and this is the reimbursement for the hush money for stormy daniels. he was also given $50,000. the money was supposed to be repayment for what cohen spent to hire a tech from to rig an online poll on trump residence behalf. as cohen said on the stand, he only paid $20,000 and cut the rest for himself. asked point-blank today whether he stole from the trump organization, cohen said "yes or". pocketing $30,000 might be

shady but it does not change the facts of the case and cohen is not the defendant. that is a point that the prosecutor made crystal clear for the jury during her redirect. she asked cohen, "are you on trial in the case?" and cohen of course said no, he is not. it might sound obvious but it was a necessary reminder. after cohen left the stand, the prosecution rested the case in the event started calling witnesses of their own. one of them was robert costello, a friend of rudy giuliani and a former legal advisor to cohen. costello testified previously before the grand jury that cohen told him that trump didn't know anything about the payments to stormy daniels. he repeated that today in court. that is when things kind of went off the rails. as the judge sustained objectives from the prosecution, they started visibly reacting. at one point, he said "gee's "" and then the judge cleared the

courtroom and admonished him like a third-grader saying that, if there is a witness on the stand and you don't like my ruling, you don't say jeez" and then say strike it because i'm the only one that can strike it. and if you don't like my ruling, you don't give me side eye and roll your eyes. then the judge went on telling him, i'm putting you on notice that your conduct is contemptuous. if you try to steer me down one more time, i will remove you from the stand. >> all in all, not a great look for one of the only witnesses the defense will call. but you can see what is happening here. the defense is calling cohen a liar. the witnesses calling him a liar. there is a lot of noise and confusion and banging on the table. but just remember, this is not michael cohen's word against theirs. it is michael cohen's word, plus the word of so many corroborating witnesses and documentation that lays out the entire crime in black and white. the defense wanted to seem like michael cohen is on trial but

he is not. donald trump is and that is important to remember her joining us now is counsel for michael cohen in the new york trial in this is her first interview following cohen's testimony. first of all, thank you for taking the time. i know you spent the whole day in court so we appreciate it. we want to start by asking you, how is michael cohen feeling about his testimony? >> would you believe i have not spoken with him since we walked out of the courtroom. and i'm going to try not to and i'm certainly advising him to stay off of media and social media. i can tell you how i feel which is not just relieved and exhausted but good. i think it was a great day for the prosecution. and i think that the total of the testimony which was over 20 follow-up 25 hours i think, in the aggregate, i think it went well. as you point out, it was a piece with the rest of the testimony in the case. so to take your language, and

say, if the fact is not on your side, pam the law. if neither are on your side, pound the table. and i think we saw a lot of that over the past week. >> there was a fair amount of table pounding including this exchange between robert costello and judge juan merchan. what did you make of that? we know what the objective was but what did you make of that and the impact on the case? >> we had hightailed out of the courtroom by then. from all accounts, this is also very much in line with what michael has testified to. and the reason why he did not trust bob costello. and so, as judge juan merchan apparently said at sidebar, the behavior ordered on contemptuous, a legal term. and i think not overly surprising given what we heard from the witness stand.

>> his objective of course was to add to the effort to discredit your client, michael cohen. years ago, he waved his attorney-client cribbage when it came to robert costello. should he regret that? >> i don't think there were any blows that landed. i think michael testified exactly what the relationship was and why he stayed at arms length from bob costello. i think the jury saw that unfold today. so, no. i think michael has been nothing but forthright with the prosecution team. some of the so-called aha or gotcha moment, were given to the defense, care of michael cohen. he is the one who first disclosed this red finch payment you referenced in your opening. he disclosed that four years ago in his book. there was no gotcha moment. he was the one who turned over his phone voluntarily to the da's office. and that is where the defense

got those so-called text messages between michael cohen and keith chiller. this has been part and parcel of michael cohen providing information and trying to be cooperative and meeting with the da's office dozens of times as he testified to. and so i think all of this is very much in keeping with the top line and the take away here is that he made his peace with his admittedly checkered past and has decided to turn his loyalties away from mr. trump and toward his family and country and to be cooperative and truthful as of the time he made the decision and he was also truthful about the money lies and mistakes he has made along the way. >> to your point, he even volunteered during testimony. he was not pushed terribly hard

on some of the specifics including the $30,000. the defense , there are strategies here. they never cross-examined cohen about a lot of parts of his earlier testimony including the crucial trump tower meeting as well as his visit to the white house. why do you think they skipped over all those topics? >> i want to first say hats off to the prosecution. i thought susan happened your data masterful job and what we called drying the sting and frontloading that damaging information. and i think there were moments where todd blanche, who is a very old friend of mine -- so i won't say much other than he probably felt that there was only damage she could do by going back to it and revisiting it. and so i think there was that and i think that they really didn't want to touch a lot of the substance. a lot of the cross-examination related to collateral matters

that really had nothing to do with the core facts of the case and court testimony from mr. cohen . so it is what i think he described as distraction, noise. it is a sideshow. smoking mirrors. it is what defense lawyers sometimes do and i don't fault them for doing it but they really didn't want to go to too close to the actual facts and the testimony. as you pointed out, i don't know if it is 20 witnesses or how many corroborated, but it is any which way both by documentary and testimonial evidence and i think it was probably a smart move to stay away from a lot of that. >> one of the things they focused a great deal of time on was the single phone call from october 24th of 2016 when they claimed that your client misremembered. and the defense said it is a lie that he spoke to daniels. it feels like a small detail in

a larger fact pattern. do you think it was a strategic decision by the defense to amplify this one phone call to make it into something bigger then it really was? or why so much focus there? >> again, i don't fault them for that. it seemed like something that, where they could elicit some inconsistencies or draw that out. and in fact, again, not a perry mason moment. this was one minute 36 seconds of the conversation. the jury heard the recorded conversation about karen mcdougal . the substantive portion was a minute. so a lot was accomplished and several other topics of conversation were discussed and that one short recording. so course a jury will be able to look at that and say, a lot can happen in 96 seconds. the prosecution could just make the jury sit there silent for 96 seconds. and they will see how long that

is. i didn't think that was a great moment on the substantive way. but it certainly -- there are things to be said about courtroom theatrics and acting like you scored big points and with the way some of the press reacted, people thought so because there was that kind of performative energy. i thought todd blanche did the best job he could with what he had. and there was baggage. no question. whenever you have someone who has pled guilty as many times as he has and has admitted it is many times as he has, you will have moments. but all in all, i didn't think october 24th, that the call was really thing other than noise and a sideshow. >> you kind of alluded to this in the baggage. michael cohen has voluntarily put some things toward it and

interview. here to break it down is former federal prosecutor glenn kershner and kristi greenberg who is the former deputy chief of the criminal district in new york and was at the courthouse today. let me start with you. we heard her take on her client's testimony over the last few days. what did you think? and was there anything she missed in terms of good or bad moments? >> as she said, her client has baggage. enough baggage to fill jfk airport. with that said, i thought he did remarkably well. i thought people were really concerned about his demeanor and how he would conduct himself on the stand. he was composed at all times. he was respectful. he never got rattled and he was generally consistent, whether he was answering questions on direct or answering them on cross. i felt like he really owned the moments that he needed to own about prior pleas and prior conduct. and i thought on the whole, he was in the position to as you

mentioned briefly, to what we sell later today which was robert costello take the stand and really just have a ton of antics. that made cohen seem all the more steady i think before, in the eyes of the jury. he provided important testimony. he was corroborated in many respects and the story generally makes sense and fits with what the other witnesses have said and what the documents show. i think overall, it was a great job from the prosecutor's. >> we are going to come back to that moment. i know you were in the courtroom for it. i want to ask a question that i wanted to ask donya perry. if you are in the courtroom, how much of this is about cohen's credibility? this seems to be a core part of the strategy, pulling it apart which we all anticipated going into the trial. >> michael cohen is an essential witness. by all accounts, he withstood something like 20, or 25 hours of cross-examination and the reporting is that he never lost

his cool. who would have thought -- i know you will talk about bob costello in a moment but who would have thought another lawyer witness would all the sudden make michael cohen look like the model of thoughtfulness and circumspection and decorum and now the story has become bob costello who let's face it, is aligned with trump and jurors will associate with donald trump, he played the fool in a way like i have never seen a lawyer play. i have seen defendants do that. but i have never seen a lawyer defend or behave that way. >> michael cohen is not a quiet wallflower. we have all met him and spent time with him. his demeanor is interesting. you were in the room for the exchange i believe between judge merchan and robert costello at the end of the day today, kristi. it was dramatic to read. there was a lot of language i would use with my children in the courtroom. the big question to me is, was this really worth it for the defense? they were trying to get him to discredit cohen. at the end of the day, was it

worth it in your view? >> no. it was incredibly stupid because any concerns that these jurors may have had about michael cohen's credibility, i think got lost and overshadowed by just how unprofessional and uncivil bob costello was to the judge. the juries tend to like the judge in the case and judge merchan is very civil and very respectful of their time. he has a very gentle way and speaking with the jury. i would expect they like him quite a bit. and for not only a lawyer who, as glenn said, i agree. i have not seen a lawyer behave like this on the stand, but to put a finer point on it, this is not just any lawyer . he was also the former deputy chief of the criminal division of the southern district of new york which was my old job and danya perry's old job. so this is somebody who should know better. and to see him act with such disrespect to the judge,

rolling his eyes and saying ridiculous absurd -- at one point, he was trying to strike his own answers to questions. he was talking over the judge . it was a lot. and i'm sure that the jury really picked up on it and really didn't like it. now this is what they are thinking about. they are not thinking about michael cohen anymore but this guy who, as glenn said, they will associate with the defense. the defense chose to call him and know he is a witness and they have to deal with the consequences of that. >> there is a certain irony. he discredited himself in his effort to discredit michael cohen. there is a lot packed in there. according to the people in the room, todd lynch was a little meandering. kind of all over the place. the way our colleague described it is, where maybe you don't know all the ingredients in a bake-off and it is all leading up to the closing statement, which means basically needs to get these things on the record. explained to me the strategy about being a little bit all over the place.

>> when i read todd blanche's accounts of the cross- examination, what came to mind for me which i was a career prosecutor. prosecutors don't typically make particularly good criminal defense attorneys. prosecutors deal in what is and what was . criminal defense attorneys deal in what could have been and what might have been and what should have been. let's engage in a little misdirection. and he came across as sort of a frustrated prosecutor. he didn't have a feel for cross- examination. cross-examination is generally about get in. make your three best points and get out. when you go on cross-examining somebody for hours and hours and days and days, you have probably lost her particularly if the witness is performing well and the jury senses the frustration of the defense attorney. they will start siding with the witness. i don't think he performed particularly well and i think that is because he doesn't have a lot of experience as a criminal defense attorney.

when donald trump spoke to reporters outside the courthouse today, he said a lot of things that were not true. what is new? but there was one comment that might have taken the cake. >> we are here about one hour early today. i was supposed to be giving a speech for political purposes. i'm sitting in a very freezing cold courtroom. >> side note, he seems very focused consistently on the temperature in the courtroom. more importantly, he said, i'm not allowed to have anything to do with politics. really? because his senior advisor jason miller would seem to disagree. miller just told new york magazine that he is full time in the courtroom and somehow is full-time on the campaign trail and maximizing every minute the president has. if he can't be on the campaign trail, we will bring the campaign trail to president trump. what he means, and we can see

for ourselves, is bringing a parade of trump fan boys and girls outside the court every day there holding press conferences to attack the judiciary system and defending the former president and many of them are doing it in matching suits and ties. jimmy's longtime democratic strategist, james carville. good to see you. we talked about this before. you have said consistently that biden shouldn't focus on this.'s focus should not be the campaign. i think campaign strategist agree with you besides fun they have on social media. do you think any of that changes in your view if trump is convicted? we don't know what will happen but if he is convicted? >> probably. i think this is a conscientious jury. i think they will need to speculate and we will have an answer. the jury will be interviewed assuming if they have a conviction. they will interview and talk

about it. they are not paying attention to the surrounding noise according to the report i listened to on your show pick that they are very engaged jurors and are paying very close attention and the judge will give them instructions. and i have always been a big believer in the jury system and whatever verdict they come up with. that is the verdict i will believe. but right now, there is nothing i can do about it. >> and we don't know how they will decide. that is how it works. if they decide, and we don't know if they will, should the biden team change their strategy? or do you think they should stay full course not talking about the trials? >> one thing to remember is when you are convicted of a felony, your whole life changes. they might take his passport away. they could limit his travel . i don't think it will put him right in jail but his life is going to change. and i don't know how to know

how people care about it. i completely agree with white house strategies. stay out of it. there is nothing to be gained here. talk about reproductive rights and talk about prescription drug prices and talk about the minimum wage. talk about raising taxes on income over 400,000 people. these are all inherent popular positions that the president takes. talking about 31,416 lives. they are every day lives. i am 100% behind the strategy. no cursing and no logs on this fire. it is raging out of control. and if he is convicted, you will have all kinds of things that will keep the story alive. >> no cursing needed i guess to your point. the kerosene is happening.

let me ask you a question. i have been on a book tour. i have talked to a lot of people out there. and the question people always ask me is about how does of course they are democrats and independents who asked me this, but how on earth is it possible that joe biden and donald trump are tied in the polls given everything? what do you say to people who ask you that question? >> i'm trying to affect the outcome of the election . i can't rationally think -- i do know this, if the president talks about the supreme court were talks about taking rights away from people or talks about capping the price of prescription drugs or talks about the minimum wage or talks about the attacks, which he will do better, i can't explain the 42% of american people who think january 6th was the tourist event. it is frustrating.

i can't change that. we have to stay focused on reinforcing support and expanding that to other people. by the way, it is a lot of noise. trump getting 22% of the vote from nikki haley are in nebraska and enclosed republican primaries. it is a tendency i think, and you know this from your time in the white house. it is always focusing on democrats in disarray. why are the democrats doing that? is not like they are doing that great work they have crazy candidates all over the country. looking at arizona, looking at the republican party lately. i would say i'm frustrated. and i think the president has to deal with it. the age issue is suffocating him. he needs to bring up that he is only four years older than trump. so say, i released my medical

records. why don't you release the records. he has to turn it around. and quit complaining about the times covering his age. that is a waste of time. don't do that. talk about how you will change people's lives and make it better and a record to build on. and you understand cost-of- living and high insurance rates. it is to the stuff that wins elections. >> this struck a nerve with me and i think a lot of people. there are so many negatives about trump. it is hard to figure out for some people out there who want biden to win or don't want trump to win, what the best negative is. biden did what i thought was a good event in wisconsin where trump promised jobs and didn't deliver. what do you think the best negative is? what is your gut on that? >> what i would like from the

white house is some guidance. some line of attack. i have said that attacking trump is like a mosquito in a nudist colony. but you have to pick one. and i'm not getting any guidance on, what is the thing about trump? was at the mismanagement of the pandemic? was it criminality on january 6th? ongoing criminality. is the fact that he is pulling for russia or is it the fact that he publicly wants to destroy nato? i don't know. but when there are so many, your cup runs over and you can't drink anything out of it. and so we do need focus on, these are the two are three things that matter the most to people.

we are back with longtime democratic strategist , james carville. i wanted to ask you about the debates. over the last couple days, we learned that the president and former president trump agreed to two. the first one is only a month away. what i'm wondering from you is, the biden team has been on more of an edge. i assume they will do that in the debate. they also have to present to the public why he is a better choice and not turn them off from that. what you think biden needs to do in this debate? >> he needs to hit this abortion issue home. that is the first thing he should do. i'm not going to point to the supreme court. i'm not going to complain about the supreme court operating under the same ethics rules. the one issue i would kick hard, and i wonder why it is not being kicked hard, is this billion dollar donation on the

off of president trump. the president and the people around him have to focus on abortion issues and this billion dollar promise for donation. they have to focus on social security and medicare. they have golden opportunities. don't worry about rfk jr. he is loony. >> you mentioned nikki haley voters earlier. i think a lot of people were trying to figure out what to make of her percentage of votes even after she dropped out. there is a lot of outreach going on behind the scenes. is their something publicly that would be appealing that the biden campaign should be doing to appeal to the voters or handled them behind the scenes? what is the best way to do it? >> i think like retired officers and national security people and retired u.s. attorneys and justice department people that have republican backgrounds, i think we need them to come out.

republican will enthusiastically accept the results. >> okay. a couple different avoidance strategies going on. some just ignoring a simple question completely and saying trump will win. some throwing in a realties about their willingness to question the outcome. we will see if it is free and fair. who knows? listening to these answers, you would think fraud had been rampant in recent elections. it has not. i will say it again. despite what trump and his allies repeatedly claim, there has been no evidence of widespread election fraud. but that does not matter too far too many members of the republican party that is led by a guy who just a few weeks ago said that he wouldn't feel good about hiring anyone who admits that his opponent won the 2020 election. which by the way, his opponent joe biden, did win. instead, doubting the election system has become a litmus test for anybody who wants a place in trump's party, let alone the role of vice president. then they really have to work for it.

you might recall in april of last year, a trend social media influencer named dylan mulvaney posted this video, the one on the screen. with bud light cans she was sent as part of a march madness campaign. you might also remember that the video started a firestorm
