You can prepare to pay for the other driver’s damages as well as paying for the ticket for driving on a suspended license and paying for the license renewal after you pay for a new policy.

You would have received notices, likely by mail, that would have told you that your policy was cancelled.

Was it cancelled for non payment?

At this point, there's not much to do unless you can prove it was cancelled in error.

Why was your insurance canceled? You want to know what happened to determine if there was some type of error. Most importantly, you want to know what happened (failure to pay, missed a notice of non-renewal, etc.) so that it doesn’t happen again. Most insurance companies offer a mobile app that you may want to download so that you can have readily available access to your insurance information.

Although less likely, If your prior insurance was canceled for reasons out of your control (=error that was not your fault/responsibility), you should obtain written proof of that from them.

Illinois (and other states) can suspend your deriver’s license and your car’s registration/plates if you are found to be driving without minimum liability insurance.

You should check to make sure that your driver’s license hasn’t been suspended for driving without insurance ASAP.

You need to get your car registered by showing proof or current and valid auto insurance. You may have to pay a reinstatement fee. Bring proof that your registration and insurance is current to your court dates.

You will be responsible to defend yourself if the other party seeks to obtain damages as a result of the car accident as you didn’t have insurance coverage at the time of the incident (if due to your own actions/inactions). The new insurance coverage that you obtained after the accident will not cover the accident you had prior to obtaining the new coverage.

Get a good traffic lawyer. You are about to take a legal beating you will NOT enjoy.

You've spoken to your insurance company since the incident. Why and when was your policy cancelled? I'm sure you asked and tried to argue with them. This is a pretty glaring omission in your post.

Why was it canceled?

Likely due to non payment.

I assumed but didn't want to assume

Thank you so much to everyone! I'm not exactly sure why it was canceled, so I'll figure that out tomorrow morning! I had chosen the prepay option where you pay 6 months at a time it had only been 3 months, so I'm also now curious about the rest of the money. This is so stressful and tiring 😭

So you called them to report a claim and they said your policy had already been cancelled…. And you didn’t ask why? If you believe you paid 6 months in advance… you didn’t bother to ask them why you did not have coverage ?

You just hung up the phone and called another company ?

I’m sorry but that’s not believable.

Make a consumer complaint to the IL DOI on their website. It probably won’t work, but at least they’ll require the insurance company to provide the notice of cancellation, proof of mailing, etc. It’s a Hail Mary at this point, but you have nothing to lose. Maybe they have a deficient notice or didn’t provide the required notice days…

Or they could just call the company and ask for the notified

The difference is that the DOI consumer services department is an advocate for the consumer and requires the company to support their position. Or, you can do it your way…. Good luck.

I'm well aware of what they do.

You don't think they did things like they were supposed to?

The will look to see if they broke any statutes... When they say we sent this on X date with a Y cancel date and prove that they sent it. They will close it.

The much easier thing to do is to call the company and ask why and when they sent it.

A DOI complaint will just waste everyone's time.

I completely think they did what they were supposed to do, that’s why I said it’s a Hail Mary in my first comment. But maybe they had a system quirk or they can’t locate a proof of mailing. It’s not wasting OPs time if they have nothing to lose in the first place.

When they call the company, what are they going to get? Some CSR telling them that “our system shows you were cancelled for [reason] on [date]. Have a nice day!”
