Cedric Wayne McFadden was fatally shot in 2005 during a robbery In Ocala, Fla. Naturally after the Medical Examiner’s Office took his badly decomposed body to perform an autopsy and relay their findings to law enforcement, they gave the body to a funeral home so his family members could mourn and bury him.

But after 19 years of thinking McFadden was resting in peace, it turns out that his family had not buried all of him.

According to FOX 35, the McFadden family received a call months ago from the Lake County Medical Examiner’s Office telling them that they still had some of the remains of Cedric in their possession.

Specifically, the office shared that they still had the skull and spine of Cedric and that they were found in a bin inside the building.

Since all of Cedric’s remains were not buried with him, his family now has plans to file a lawsuit against the Lake County Medical Examiner’s Office, claiming that they did not use ordinary care to keep all of McFadden’s remains intact when releasing his body to the funeral home.

More from FOX 35 on what Ortavia Simon, the attorney for McFadden’s family, says about the lawsuit:

“From my experience with these cases, this is probably by far the most bizarre that I’ve ever encountered in mortuary litigation,” said Simon.

“Not only did it take one year, it took almost 20 years for them to finally reach out and be accountable to this family that they have not been given all of the remains of their loved one. It is an absolute travesty,” he continued.

During a Monday press conference, Forshee McFadden, Cedric’s sister, said, “Unfortunately, my brother’s body was too decomposed. The state of it was not viewable.”

She continued, “It was unreal, to be honest with you. It was a very traumatic experience because he was murdered. So that was hard within itself. So now we’re doing this all over again.”
