VMware settles patent lawsuit after Densify's $84.5 mln trial win

Broadcom's AVGO VMware has resolved a lawsuit brought by rival software company Densify after it lost a $84.5 million jury verdict in the case last year, according to a filing in Delaware federal court.

The companies told the court on Friday that they had settled the case and asked to pause the proceedings while they prepare a settlement agreement. Representatives for Densify and Broadcom did not immediately respond on Monday to requests for comment and more information about the settlement.

Densify and VMware, which Broadcom acquired last year, both specialize in cloud-computing software. In a 2019 lawsuit, Densify accused VMware of infringing patents covering software for optimizing "virtual machines" used in cloud computing with its vROps, vSphere and other products.

VMware argued it did not infringe and that the patents were invalid, and later filed patent-infringement counterclaims against Densify.

A jury found last year that VMware's software violated Densify's patent rights and awarded $84.5 million in damages. Densify had previously won a verdict worth nearly $237 million against VMware in the same case in 2020, which a federal judge later threw out.
