CVS Suit Over Delayed Generics Dismissed by Second Circuit

CVS Pharmacy Inc. and Rite Aid Corp. failed to convince a federal appeals court that a brand name manufacturer unlawfully reversed settlement payments to delay market entry of a generic version of a high-blood pressure drug.

Forest Laboratories, the brand manufacturer of the high-blood pressure drug Bystolic, won again in a case brought by CVS, Rite Aid, and other plaintiffs contending the drugmaker paid off generic manufacturers to delay generic products to the market, according to a Monday opinion from the US Court of Appeals for the Second Circuit.
