ENDORSED ORDER DISMISSING CASE. On October 17, 2016, Plaintiff filed a pro se Amended Complaint (D.E. 8). The Court has conducted a preliminary screening of Plaintiff's Amended Complaint pursuant to 28 U.S.C. 1915(e). Having done so, the Court concludes that Plaintiff's claim must be dismissed as time-barred. See Bishop v. Dep't of Justice , No. 11-20518 CIV, 2011 WL 4117385, at *2 (S.D. Fla. Apr. 7, 2011), report and recommendation adopted, No. 11-20518 CIV, 2011 WL 4104906 (S.D. Fla. Sept. 15, 2011) (citing Pino v. Ryan , 49 F.3d 51 (2d Cir. 1995)) ("A district court may sua sponte dismiss a pro se civil rights action for failure to state a claim pursuant to 28 U.S.C. 1915(e) on grounds that the face of the complaint clearly establishes that it is barred by the applicable statute of limitations."). The Plaintiff attempts to state a Section 1983 claim against officers for his arrest that occurred on September 22, 1991. (D.E.8 .) The limitations period for filing a Section 1983 complaint is four years the same limitations period allowed for filing a personal injury action under Florida law. See Henyard v. Sec'y , DOC, 543 F.3d 644, 647 (11th Cir. 2008) ("[A] 1983 action brought in Florida is governed by Florida's four-year personal injury statute of limitations."). Plaintiff's claim accrued over twenty-five (25) years ago and is therefore untimely. Accordingly, it is ORDERED AND ADJUDGED that Plaintiffs Amended Complaint is dismissed as time-barred, all pending motions are DENIED AS MOOT; and this case remains CLOSED. IT IS SO ORDERED. Signed by Judge Joan A. Lenard on 10/19/2016. (jts) |
