A Queens man is being freed from prison Tuesday after spending more than 16 years behind bars for a murder he did not commit, his lawyer said Monday.

Tullie Hyman, who was convicted in the murder of a Far Rockaway tenant activist in 2002, had his conviction overturned in July after witness testimony against him was discredited.

On Tuesday, Hyman will finally walk out of Eastern Correctional Facility a free man, his lawyer, Michael Aviles, told The Post.

Hyman was sentenced to 21 years to life for the murder of Maria Medina, 45, who was killed by stray bullets fired during a gunfight at the Redfern Houses in March 2000.

Medina, the mother of three children, was part of a tenant patrol in her building’s lobby when she was fatally struck.

A sole witness, Shaquana Ellis, said she saw the shooting and identified Hyman as the gunman during his trial in 2002.

Ellis, however, later recanted her testimony and said that she was threatened to finger Hyman.

Hyman has maintained his innocence since the day he voluntarily turned himself in more the 16 years ago.
