Dfts Schroeder and Ryan must answer Counts V, VI, and VII of the Amended Complaint. Pla must complete and return the service packet to the Clerk of Court within 20 days of the date of filing of this Order. This matter is referred to Magistrate Judge Jay R. ORDER - IT IS ORDERED: The reference to the Magistrate Judge is withdrawn as to Dfts' 18 Motion to Dismiss, Pla's 16 Motion for Emergency Preliminary Injunction, Pla's 22 Motion for Emergency Action, Pla's 24 Motion to Strike, and Pla's 30 Motion to Compel Release. Dft's 18 Motion to Dismiss is granted. Pla's 24 Motion to Strike is denied. Pla's 16 Motion for Preliminary Injunction, 22 Motion for Emergency Action, and 30 Motion to Compel Release are all denied as moot. This action is dismissed without prejudice for failure to exhaust.
