Is Rash Curtis & Associates Calling You? Here’s What You Need to Know*

If a debt collector contacts you, you should be expect to be asked to pay a delinquent debt, but in a professional manner. If the collection agency that has been assigned to recover your debt harasses or attempts to intimidate you, there are ways that you can stop them without resorting to bankruptcy.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA), which is enforced by the Federal Trade Commission, regulates what third-party debt collectors can say or do when attempting to collect a debt from you.

Collection tactics like the following are illegal and can result in fines and even license revocation:

  • Swearing at you and yelling
  • Threatening to have you arrested, seize your property or garnish your wages
  • Discussing the debt with anyone except you, your attorney, and possibly your spouse
  • Calling you at work if you’ve already told them that such calls are not permitted by your employer
  • Claiming to be police officers or other law enforcement figures
  • Refusing to provide proof that you owe a debt and they are authorized to collect it

Company Profile: Rash Curtis & Associates

Rash Curtis & Associates is a collection agency located in Vacaville, California. It was established in 1995, has 50 to 99 employees, and is managed by its President, Terrence Pass.

A review of litigation records archived at the PACER (Public Access to Court Electronic Records) website reveal that Rash Curtis & Associates has been accused of violating the FDCPA when attempting to collect certain consumer debts.

Alleged Violations by Rash Curtis & Associates

According to PACER, in September of 2014, an Illinois resident began receiving calls from Rash Curtis & Associates. She later complained that collectors called her several times a day on both her home and cell phones.

Each time, she stated that she was experiencing financial difficulties and could not make a payment, but the calls allegedly persisted.

Then, in November, she told them to stop calling because she worked the graveyard shift and the calls were interrupting her time of rest. The Rash Curtis & Associates representative replied that her work hours would be noted in her file, but the calls continued.

She finally hired a consumer attorney and sued Rash Curtis & Associates for allegedly violating the FDCPA in the following ways:

The matter was later dismissed.

Hire an Attorney

The phone numbers for Rash Curtis & Associates are 1-866-729-2722 or 707-454-2010. If you see either number on your caller ID, a debt collector may be calling. If they call at inconvenient times or appear to be contacting you solely for the purposes of harassing you, hire a consumer attorney.

Such conduct is illegal under the FDCPA, and your attorney can help you sue. You could potentially win $1,000 per FDCPA violation as well as attorney’s fees, court costs, and any actual damages. You may owe a debt, but collection agencies disregard your rights at their own risk.
