OPINION & ORDER granting re: 16 MOTION to Dismiss the Complaint for Forum Non Conveniens, filed by The Coca-Cola Company. In an abundance of caution, however, the Court conditions dismissal as follows; in the event that (1) this case is dism issed in Guatemala under the Defense Law, and this result is affirmed by the highest court of Guatemala or (2) Plaintiffs are required to return to Guatemala to prosecute this case, the Court will be open to reconsider this holding.
