I have read several other bad reports with regards to The Law Offices of Kirk A. Cullimore and even though this attorney may call these reports "sour grapes", my experience with them has been almost exact as the others.

My young daughter, barely 20 rented an Apartment with Miller Estates. Making absolutley no excuses for my daughter, she definitely went through her routy stage and was evicted from the apartment. She was 100% in agreement that she was in the wrong and that she would do anyhting and everything to work with Miller Estates, of which they were happy to work with her up until she signed her eviction notice, that quickly they turned the papers over the The Law Offices of Kirk A. Cullimore. She sat down with The Law Offices of Kirk A. Cullimore and went through each discrepency line by line and once the amount was agreed upon, she signed a payment plan with The Law Offices of Kirk A. Cullimore.

In September she needed to pay off another bill and asked The Law Offices of Kirk A. Cullimore, if it were possible to skip 3 payments and start up again in December and if this was possible.

I came into the picture, when for the last 3 weeks I have heard my daughter trying to contact someone that could speak to her about her account as she received a phone call three weeks ago that she needed to pay the entire balance by January 26, 2011 or they would take her to court. The balance that they wanted by January 26, 2011 is $2,000 more then the original balance. Then "just" today, she received a REQUEST TO SUBMIT FOR DECISION, as it stated that they had sent her The Motion and Supportive Memorandum were filed on December 3, 2010 and they had not received a response from my daughter. This would be because, nothing was sent to our address on December 3, 2010. We have no idea where it was sent, but from reading all of the other reports, it probably went to her old apartment, of which, The Law Offices of Kirk A. Cullimore, LLC, are fully aware that she no longer lives there. P.S. the new Augmented Judgement and Order has increased even another $2,000, so now a 20 year old has a supposed debt of $6,000, of which $4,000 can not be accounterd for, as well as, now that I have gotten involved and running the Accounting Department for a rather large Company, has come across several double charges on my daughters account and future rents that extend longer than her original lease.

What has gotten the most of my attention is the fact that this Firm can come up with ficticious amounts, that do not require back-up, they can say that they sent letters to people without being required to show any proof, such , as a certified letter, and that they are getting away with this. With a father that has retired frrom the FBI and working in the Professional Licensing Division, this has now become my New Year's resolution, to make sure that this is brought to the public attention, in everyway possible.

You must be a family member or paid, I just got done having to toe to toe this scumbag leech whom BTW's lunch I just finished chewing up and spitting out.

I kicked the dirtbag's fanny and even after he lost he still tried to Manufacture yet Another BS case and fake more phoney charges.

If you're scummy enough to hire this skeez all I can say is I would be more than happy to slap this firm around a lot more and you with them.

Don't be victims people this attorney is a walking talking joke among his "colleagues" and this fools comment should go in one ear and out of your behind........

Complaint...or Compliment?

As a prospective client of the Law Offices of Kirk Cullimore, LLC, I'm very pleased to read this 4-year-old "complaint" from the aggrieved father of a 20-yr-old daughter who is being pursued by Cullimore for her failure to make good on the payment plan that she "was 100% in agreement" with when she signed it.  

Does this parent, who concedes his daughter's mischief in getting evicted in the first place from the Miller Apartments, realize that this is what we hire collection lawyers for?  I'm delighted to hear that Cullimore was aggressive and thorough in pursuing this landlord's claim against this young adult, especially when the terms of her IOU were carefully spelled out "line by line...the amount agreed upon...and she signed a payment plan with The Law Offices of Kirk A Cullimore".  Since Cullimore is working for the injured landlord, but still took time to "sit down" with the evicted tenant to work out an agreeable payment plan, Cullimore went above and beyond its call of duty to find a workable solution for both parties.

This father's grievance then moves to what happens next.  After her payment agreement begins, she makes an unsuccessful request to skip 3 payments.  Then, after her apparent default, the inevitable collection call comes, followed by a demand letter and then court filings (with escalated costs, of course).

Cullimore's efforts apparently succeeded in getting the daughter...and her father's attention, which is what they are designed to do.  

Thanks for posting this "complaint".  Looks like a good firm to have in my corner!

disbute the debt in writing and file a complaint with attorney General

I am not an attorney. So any advise should be verfied that it applies to your state.

I would begin by filing a complaint with the Attorney General office of your state. You dispute is the balance is an abuse of prejudgement and post judgement interest laws. Most states limit both.

If they take you to court then goto Debtorboards{dot}com. Its free and they do not try get you to buy anything. They have people that can give free advise and help you.

I would also file a complaint with the Federal Trade commission. Another course of action is to file a complaint with the state about this lawyer. If he served papers at the wrong location and she can prove that she was evicted and law office knew then then they are trying to get a judgment by whats called sewer service.

You can go back into court and file a motion to vacate the judgment. That sounds like you best bet. Now you need to research that with Debtorboards.
