Hello and thank you for requesting me.

Can you give me more of the sentence in which this is used? And in what part of the pleading?
Customer
On the first page of the complaint, In the "title" area ... to the left of the case #XXXXX etc.
Thank you.

This is just a "legalese" way of naming the Plaintiff an Defendant. It has no bearing on your case overall.

I hope you found my answer helpful, and if so please click on the ACCEPT button. This is the only way for me to get credit for my work; I receive no credit for my time with you until you actually press ACCEPT. If you still need to clarify something or seek more information, just use the REPLY button and I’d be more than happy to follow up to your satisfaction! There is no fee for follow up questions before or after accepting, should you wish to continue in the thread, and I encourage you to do so should you desire clarification.

If you feel that I went an extra step to help, a bonus is always appreciated!

While the legal system tries to be inclusive of every possibility, sometimes, people are morally wronged but have limited legal avenues to seek relief. If so, please understand that this is not the expert’s fault (in other words, I prefer to tell you the truth rather than tell you what you want to hear, so if the news is not good, please do not shoot the messenger).

It's not just they're on a "fishing expedition"? I don't remember if my husband's name was on the original credit ap, but assume that if it was...he'd be listed.

Do I use the defendant section of the complaint EXACTLY as shown for my ANS?
Was your husband's name on the summons when he was sued?
Customer
No, just mine
Thank you, XXXXX XXXXX kind of pleading is this that has said heading on it - what it is entitled?
Customer
It is a Complaint from Citibank to me for unpaid credit card debt.
Thank you. Then they are alleging only those that they know are defendants. Do file an answer in his name, but it is not a "fishing expedition," and they do know who he is, if this is what you meant.

The summons came only to me. The complaint has my name plus that "Does I through X...".

So, if I understand correctly, in my Answer I title it exactly as they did in the Complaint (my name and the "Does I through..."

I think we were mis-communicating. if this is a SEPARATE summons from your husband's case, and a different case, then yes, you haver to put your name on the response.

No, you do not have to style it like they did - (Plaintiff's Name) v. (your name) would be just fine.

ROE Corporations applies if you hold any major stock, etc. It plays no bearing here (assuming you have no major stock).
